WITNESSETH, that the party of the first pan, to whom letters testamentary were issued by the Surrogate's
Caun, Suffolk Counn•, New York on May 24, 2006 and by virtue of the power and authority given in and by said
last will and testament, and/or by Article I I of the Fstatcs, Powers and Trusts Law, and in consideration of

grant and release unto the pally of the second part, the distributces or successors anJ assigns of the pony of the

situate, Iving and being in the Town of Southold, County of SulTolk and State of Nrw York, bounded and
described as follows;
BEGINNING nt a concrete monument on the southerly line of land now or fotmprly of Kemeny where
the same is intersected by the Sadowski & Purcell and the nonhwestcrly corner of the premises herein
described:
RUNNING THENCE Sguth 28 degrees 46 minutes 00 seconds West along said land now or formerly of

BEING.4ND INTENDED TO BE the same premises conveyed in deed dated 07/05/55 and recorded on
07/07/55 in l.iber 3932, page 270.
TOGETHER wlrh the right to the use (in common with others) of a right of way I S feet in width along
the northeasterly boundary of the premises hom n point about 36 feet nonhwestcrly from the easterly cororr
of said premises southeasterly to said easterly comer.
TOGETHER wlrh the right to~lhe use (in common with other) of a right of way 30 feet in width from the
easterly comer ofthe prcmius southeasterly about 1150 feet to Sound View Avenue, the center line ofsaid
30 foot right of way beginning at said easkvly corner and running southeasterly to Sound Virw Avenue;
RESERVING however, to the party of the first pan, his heirs, Icgal rcprcsentativc and assigns, a right of
way over a strip of land 36.17 first wide across the southeasterly end of said premises, the suuthcaskvly line of
which is the southeasterly lint of the premises herein described;
TOGETHER w/rh, the right to the uss (in common with others) of a right of way 35 fart in width ~
extended from the southwesterly comer of the premises southwesterly a distance of 204 fart, more or Icss, to
a SU fan right of way;

convey or dispose al; whMher individually, or by vinue of said will or otherwise,

TO HAVEAND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first pan covenants that the party of the first part has not done or sutTcrcd anything
whereby the said premises have bern encumbered in any way whatever, except as aforesaid.
AND the parry of the first part, incompliance with Section 13 of the Lien Law, wvcnants that the patty of the
first pan will receive the consideration for this conveyance and will hold the right to receive such consideration as
a trust fund to be applied first for the purpose of paying the costs of the improvement and will apply the same first
to the payment of the wst of the improvemrnt before using any pan of the total of the same for any other purpose.
The word "parry" shall be conswed as if it read "parties" whenever the sense of this indenture so requires.
