Northport, New York 11731, pa-ty of the second part,
WITNESSETH, that the party of the first part, to whom letters tcsutrrlcntary were issued by the
Surrogate's Court, Suffolk County, New York (File No. 137P2007) on February 9, 2007, and by virtue
of the power and authority given in and by said last will and testament and/or by Article 11 of the
I DUD Estates, Powers and Trusts Law, and in consideration of FOUR HUNDRED EIGHTY FNE
037 ~ THOUSAND ($485,000.00) DOLLARS, paid by the party of the second part, does hereby grant and
03.OV release unto the party of the second part, the distributces or successors and assigns of the party of the
second part forever,

ALL that certain plot, piece or parcel of land with the buildings and improvements thereon erected,
situate, lying and being in the at East Marion, in the Town of Southold, County of Suffolk, State of Ncw
York, which plot is known as and by the Lots numbered 42, 43 and 44 es shown on a map entitled "Map
of Section Two Oardincr's Bay Cstates, situate at East Marion Long Island,' which map was filed in the
Suffolk County Clerk's Office on September 23, 1927, under the Ntunber 275, being bounded and
described as follows.
BEGINNING at the comer formed by the intersection of the southerly side of Locust Court with the
easterly side of Old Orchard Road;
RUNNING THENCE along the southerly side of Locust Court. North 58 degrees 58 minutes 30 seconds
East, 115.95 feet;
THENCE South 31 degrccs Ol minute 30 seconds East, 120.00 feet;
THENCE South 58 degrees 58 minutes 30 seconds West, 115.95 feet to the easterly side of Old Orchard
Road;
THENCL• along the easterly side of Old Orchard Road, North 31 degrees 01 minute 30 seconds West,
120.00 feet to the point or place of BEGINNING.
TOGETHER with the right of way to pass and repass for street purposes Duct all streets on said map
including "the paths" leading to the beach as well as all other rights and privileges granted to the party of
the f first herein by deed dated August 30, 1950 between '`Gardners Bay Company Inc.;' as grantor, and
Frederick Allen Rattenbury and Duris P. Rntunbury, his wife", as grantees, which said deed was
recorded in the Office of the Clerk of Suffolk County on November 27, 1950 in Liber 3157 at Pagc 153;
and, subject to sll of the obligations, covenants, and restrictions set forth in said deed to the extent that
the same may now be in force and effect.
BEING AND INTENDED TO BE the same premises conveyed to Doris P. Miller by deed dated March
31, 1981, and recorded June 4, 1981, in the Office of the Suffolk County Clerk in Liber 9012, Page 210.
TOGETHER with all right, title and interest, if any, of the parry of the first part in and to any streets and
roads abutting the above described premises to the center line thereof,
TOGETHER with the appurtenances, and also the estau which the said decedent had ut the time of
decedent's death in said premises, and also the cstau therein, which the party of the first part has or has
the power to convey or dispose of, whether individually, or by virtue of said will or otherwise,
TO HAVE AND 'I'O HOLD the premises herein granted unto the party of the second part, the
distributccs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the parry of the first part has not done or suffered anything
whereby the said premises have been incumbercd in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the pony
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first fur the purpose of paying the cost of improvement and
will apply same first to the payment of the cost of improvement before using any part of the total of the
same for any other purpose.
The word "parry" shall be construed as if it reads "parties" whenever the sense oC this indenture so
requira.
