Being of the same premises conveyed by deed to grantor dated January 12,1987, recorded January 28,1997 in
Reel 10232 Page 51
The Grentors, Antonios Ldis and Sandre Lolls, reserve the right to the exclusive use and occupancy of the
premises during the Grentors' lifetimes, with the Grentors to pay for all maintenance and repairs, water and sewer
charges, Insurance charges, and taxes relating to the said premises. Sold life use shall be personal to the
Grantors, Anlonios Lolls, and Sandra Lolis, and shall not be subject to the assignment or lease, except as otherwise
provided in this paragraph. The Grantors reserve the power to appoint the remainder and/or Grantors' lives use
in the premises to any one or more of the issue of said Grantors, siblings, or the spouses or survNing spouses of
any of the toregoing persons, with the term 'issue' baing deemed to include persons, who have been adopted
according to law or bom out of wedlock. This power shall be exerdseble or may be relinquished during the
Ilfetimes of the Grantors, by a deed to the Grantees herein or to others who are members of the dose of appointees
set forth herein, making express reference to thla power and executed and recorded in the County Clerk's office
where this deed is recorded, prior to said Grantors death. No exeroise of this power shall be deemed to release is
explicl0y made in a deed. The exercise of this power shall not exhaust It, end unless the power is speciticalry
released in such a deed, the deed recorded lest shall wnVOl as to any ambiguities or inconsislendes.
TOGETHER with all right, title and Interest, if any, of the parry of the first part in and to any streets and roads
abutting the above tlestxibed premises to the center lines thereof; TOGETHER wlfh the appurtenances and all the
' estate and rlghls of the party of the first part In and to said premises; TO HAVE AND TO HOLD the premises hereto
granted unto the party of the second part, the heirs or successors and assigns of the parry of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideretion for this conveyance and will hold the right to receive such tbrtsideretlon as a Wst
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the Improvement before using any part of the total of the same for any other purpose. The
word 'party' shall be construed as H it read 'parties" when ever the sense of this Indenture so requires.
