of the second part, the heirs or successors and assigns of the party of the second part forever, an undivided

ALL that certain plot, piece or parcel of land, with the buildings and Improvements thereon ereded,situate, lying
and being at Fishers Island, Town of Southold, County of Suffolk and State of New York, being more paNcularty
bounded and described as set forth on 5dredtde A hereto.
BEING AND INTENDED TO BE one-half of the party of the first part's undivided fifty percent (5096) interest in
thesame premises acquired by Donald W. Sindairand Alice H. Slndairinthreeseparete incremental coveyances
by deeds recorded in the Office of the SuffoBc County Clerk In Uber 2931 page 420, Uber 5452 page 523 and
Liber 8331 page 421, respectively, the party of the first part having acquired his undivided fifty pWCent (5096)
interest in such premises from the Estate of Alice H. Sindair by deed recorcled In the Office of the Suffolk County
Clerk In Uber 11808 page 959 and pursuant to the last Will and Testament of the said Alice H. Sinclair (Suffolk
County Surrogate's Court File No. 1394 P 1998).
TOGETHER with all right title and interest, If any, of the party of the~flrst part In and W any streets and roads
abutting the above described premises to the center Imes therBOf: TOGETHER with the apptutenancea and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenarNs that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, incompliance with Section 13 of the Llen Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to reoeNe such consideration as a
trust fund to be applied first for the purpose of payirp the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using arty part of the total of the same for arty other
purpose. The word "party" shall be construed as If It read "parties" whenever the sense of this indenture so
requires.
