Lyon and Natalie Du Pont Lyon Property Location: 8 Shingle Hill Drive, Fishers Island CTM 9-1-15 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicants' property contains .27 of an acre and is located in an R-40 Zone District. The property is improved with a single family dwelling as shown on survey prepared by CME/CPK Design Group dated 3/31/03. BASIS OF APPLICATION: Request for a Variance under Sections 280-14 and 280-122, based on ZBA Interpretation #5039 (Walz Application), and based on the Building Inspector's April 24, 2007 Notice of Disapproval concerning a proposed additions and alterations to a (nonconforming) third- story bedroom in an existing single-family dwelling, which will constitute an increase in the degree of non-conformance (third floor/third story). FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 28, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants request a variance to construct a small dormer addition to expand the size of an existing bedroom, using the nonconforming third floor of the building (footprint) setbacks as exist of their dwelling. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because the proposed dormer addition would be within the existing dimensions (building/footprint) and the height of the proposed new dormer roofline at 27.6' would be less than the height of the ridge of the existing house at 30.6'. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicants to pursue, other than the relief requested because the owner/applicant needs to expand the size of a very small existing bedroom and any expansion within the dwelling's existing envelope would increase the degree of non-conformity of this three story non-conforming house. The severe slopes on the property make additigns to the first floor unfeasible and would result in a greater impact. 3. The variance granted herein is not substantial. The proposed dormer addition is only 35 square feet, which will increase the size of the existing bedroom from 122 square feet to 157 square feet. There will be no change in the existing setbacks, footprint or height of the dwelling. 4. The difficulty has not been self-created. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood because a bedroom is permitted within a dwelling and the dormer will have minimal visual impact. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a dormer addition to an existing bedroom, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Oliva, and duly carried, to GRANT the variance as applied for, as shown on the site survey map prepared by CME/CPK Design Group dated 3/31/03 and architect plans (Pages 2.1, 3.1, 4.1, 5.1) dated 2/8/07 and drawing with area calculations dated May 9, 2007, prepared by Albert, Righter & Tittmann Architects Inc. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
