(631)765-1809•Fax (631)765-9064 fzit art- FINDINGS, DELIBERATIONS AND DETERMINATION SA Ili rt/n MEETING OF MAY 10, 2007 ZB File No.6018 —Jerry and Linda Matejka Property Location: 1300 Strohson Road, Cutchogue CTM 103-10-27 SEQRA DETERMINATION: The Zoning Board of Appeals (ZBA) has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. _ EXISTING PROPERTY FACTS/DESCRIPTION: The applicant's 15,587.24 square foot parcel has 106.70 feet along Strohson Road and is improved with a single-family dwelling, accessory shed and accessory garage, as shown on 1/3/2000 survey. The existing lot coverage for the property was confirmed by Joseph A. Ingegno, Land Surveyor, in a letter dated February 21, 2007 to the ZBA at 2,782 square feet, or 17.84°/x. BASIS OF APPLICATION: Request for a Variance under Section 280-15, based on the applicants' request to amend Building Permit No. 32557-Z, based on the Building Inspector's February 2, 2007 Notice of Disapproval concerning the existing garage located in a yard other than the code-required rear yard. The new construction places the existing garage in a side yard. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated April 12, 2007 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. TOWN CODE CHAPTER 268 LWRP DETERMINATION: The applicants are requesting an 8 ft. by 26 ft. covered open porch on the west side (entirely landward) of their home. The ZBA jurisdiction is based on the location of the existing garage, of which half will be located in a side yard instead of code permitted rear or front yards locations, after the porch is built. This applicant's application for an area variance is exempt under Chapter 268. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 26, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: • Page 2— May 10,2007 • • ZB File No. 6018-Jerry and Linda atejka CTM No. 103-10-27 AREA VARIANCE RELIEF REQUESTED: The owner/applicant seeks a variance for the location of an existing garage which will be partially in a side yard as a result of the proposed construction of a porch addition to the dwelling. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The preexisting garage is presently located on the street side of the home. The fact that part of the garage will be along side the porch, as opposed to the yard in front or behind the house, will make little or no difference to the appearance of the property. 2. The benefit sought cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Removing part of the porch would not achieve significant gain, and relocating the garage is precluded by its age and condition. 3. The relief granted herein is not substantial, for the same reason stated in #1 above. 4. The difficulty has been self-created, but only in the sense that it resulted from the construction of a porch addition on the street side partially adjacent to a pre-existing garage. 5. No evidence has been submitted to suggest that failure to remove the garage for a new porch will have an adverse impact on physical or environmental conditions in the neighborhood. In addition, the lot coverage is less than 20% as confirmed in the February 21, 2007 letter to the ZBA by Joseph A. Ingegno, L.P.S. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a porch addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for, as shown on the 1/3/2000 survey, revised November 22, 2005 by Joseph A. Ingegno, Land Surveyor, Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. LETTER OF EXPLANATION To: Southold Zoning Board The purpose of this attachment is to clarify what our appeal is all about. Mound November 15, 2006 when our Contractor Mr Don Connolly of D&T carpentry went to file for a Building permit for the renovation to our house at 1300 Strohson Road Cutchogue (# 32556), we were informed by the Building Department that the house plans being submitted will make the existing detached accessory garage non conforming since a piece of it will be in the side yard. Unfortunately, our Architect Don Feiler who designed the house over a 14 month period never informed us that the new front porch would create this situation. Had we been informed, the house would have been designed differently. Now, the Building Contractor wanted to get started before winter, so we obtained a separate permit to relocate or demolish the garage(# 32557) because the building Department was not otherwise going to issue a permit for the house renovation. Mr. Simon asked during the hearing as to what portion of the garage was non conforming. I calculated two ways and the number is either 144 sq ft or 168 sq ft as explained below If it's calculated on the basis of the newly constructed open front porch from the current house renovation underway, the square footage of the nonconforming part of the garage is 144 square foot total(8xl8feet) into the sideyard. The new porch extends 8 feet forward from the existing structure and the detached garage width is 18 feet Since the garage was in conformance for 75 years prior to the recent house renovation underway, we can reasonably say the above information is accurate. The Southold Building department also told us also that it was the new front open porch that was creating the non conformance when we filed for the permit for the house renovation last November. The second method involved doing a true measurement. First, I observed that technically speaking, perhaps 1 X14 feet of the garage was already into the side yard before any renovation and was previously considered conforming basd on the right front corner foundation of the house. If I do the calculation of the exact total in the sideyard makes the total 168 sq feet nonconforming.
