THIS INDENNRE,made the 29thday of July ,nineteen hundred and sixty. five
BETWEEN
Frank J. Carnabuci, and Cannella B. Carnabuci, his wife,
jresiding at 27 Horseshoe Road, Mount Kisco, New York,
a
party Of the first part,and Philip C. Fuller, and Edith 19. Fuller, his wife,
sR > I residing at 180 Willis Avenue, Box 37, Hawthorne, N.Y.,
party of the second part,
WT NESSEI'H,that the party of the first part,in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part,does hereby grant and release unto the party of the second part,the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot,piece or parcel of land, meatwk situate,
lying and being in the Town of Southold, Suffolk County, Iiew York, and
known and designated as the southerly half of Lot ITO. 54 on a
certain map entitled -Subdivision lap Section One of Property of
George I. Tuthill and others, situate at Laurel, Town of Southold,
N.Y.- surveyed fgarch 28, 1928 by Otto w. Van Tuyl, Greenport, N,y,
Surveyor, and filed in the office of the Clerk of the County of
Suffolk on the 15th day of January 1929 as Ttap No, 861.
The premises hereby conveyed are bounded easterly by Bray
Avenue 25 feet, southerly by Lot -55 on said map 150 feet, westerly
by lot No. 52 a distance of 25 feet, and northerly by the remainder
of Lot #54 a distance of 150 feet.
Together with all the right, title and interest of the party
of the first part in and to Bray Avenue adjacent to said premises
to the center line thereof.
Together with the privilege in common with others to use a i
right of way leading from the Boulevard, so called, to Peconic pay,
which said privilege is contained and recited in a deed to George
I. Tuthill, at al, dated April 17, 1928 and recorded August 13,1928 in
Suffolk County Clerk's office in Liber 1388 of Deeds nage 24.
Being and intended to be the southerly half of the premises
conveyed to the party of the first pFrrt by Katharine Baylis Tuthill
by deed dated Tlay 18, 1957, and not yet recorded, and subject to j
the covenants and reatrictions therein contained.

TOGETHER with nil right,title and interest,if any,of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thercof;TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to saidpremises;TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part,the heirs or successors and assigns of
the party of the second part forever.
AND the party o1 the first part covenants that the party of the first part las not done or suffered anything
whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first par,in compliance with Section 13 of the Lien Law,covenants that the party of
the first part
will
receive the consideramn for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same firs[to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word"party"shelf be construed as if it read"patties"whenever the sense of this indenture so requires.
