Dear Trustees, During the past seasons, three (3) large precast cesspool rings and covers were stored on town property east of McCabes' beach parking lot. It was thought by many that they were there for the purpose of the town beach','llaboratories. To the east of the town, property is a privately owned parcel of land size approx. 125' east and west on North Sea Drive and approx. 300' north to L.I. Sound and south. There are four (4) cottages on the property each owned and maintained by four (4) different owners although the land is owned by all. All cottages are located close to North Sea Drive. As noted on the attached diagram, cottage B is owned by myself and cottage C is owned by Steve Brautigam, home address: 2715 Laurel Way Spur, P,O, Box 611, Laurel, NY 11948. Cottage C's cesspool which is slightly above ground located 2 1/2 feet from the west rear corner of cottage B. This was discovered after it started to overflow as it was hidden by high brush. I later learned that is was installed by the previous owner. Daring Jan, 2005, it over- flowed and again in 2006, Steve was difficult to communicate with however was advised of this situation from the beginning. As time past and nothing was done to correct this unhealthy situa- tion from the beginning, a report was made to the Suffolk County Board of Health Dept. A year later, it overflowed again and the Suffolk County Board of Health was again notified including the Suffolk County Waste Management Dept. It wasn't until May 5, 2007 later that day and much to our surprise an unknown contractor came with all its equipment. They bulldozed a large path through the Town Property and in- stalled three (3) large preccast cesspools (that was stored on Town property) behind collage C which is approx. 30 x 30 x 18 in size. The old cesspool has not been removed nor did I see any building permits posted. The count is now four (4) for cottage C. Cottage A & B share one (1) large precast cesspool and Cottage D has one precast cesspool. All were installed many years , .' ago. There are now a total of six (6) cesspools on the property. There is also well water located in the northeast corner that was newly installed just before Suffolk Water came and is still in use. Tenants in cottage C maintain property like a junk yard. My question is, are the cesspools installed according to code and say in a year or two from now, if I decide to install cesspools, will I have the same privileges? Thank You for Your Review. Murphy PO Box 374 Southold NY 11971 Southolrl Town Clerk RE: Complaint letter, cesspool installation Dear Mr. Murphy, The Town Clerk has forwarded a copy of your letter to my office. I have investigated this location in response to a complaint I received on May 8,2007. The complaint concerned a possible unsafe condition, specifically the storage of pre-cast rings allegedly on Town property. I inspected the site the next day (5/9/07) and found the rings to have been removed, further inspection revealed they had been installed on the property adjoining the Town beach. I returned to my office and researched the property records and found no permits for this activity. I contacted Suffolk County Dept of Health and an inspector was dispatched. I met him at the site and we inspected it together. He had reported researching the history of this location and found several old complaints concerning overflow incidents. He returned to his office to consult with his supervisor. I was contacted the following day and informed that Suffolk County would not require the owner to obtain a permit for a new septic system as this activity was considered a repair of an existing system with a history of chronic failures. In the meantime I had contacted the Town Trustees as the activity may have fallen within their jurisdiction. A field visit from them indicated it was not. My office is proceeding to serve the owner with violations of Town Code for failure to obtain a Town Sanitary Permit and for the open storage of debris. "; "',' ~ .~ ; Included in your reply, it was mentlohedJhat you were informed by SuffolkCountyDept. of Health that a permit to replace a troubled c.~ss]Jool with a new cesspool was not required. I received the same information. However, this did noloccur.. The troubled~esspoo1.unfoftu- nately still exists. Instead, around the top opening were a couple placed bricks arid a new cover, all above ground level. The SCH received a phone call stating that repairs were made. It is located 2.5 feet away from cottage (B). Please see attached photo. The SCH rules for a cesspool placement is approximately 10 feet away from any building structure. In my opinion, the three (3) precast cesspools were not properly installed. I have enclosed three (3) photos taken on September 22, 2007 showing the areas around cottage (C), collections and storage of debris, and also the troubled cesspool by cottage (B).
