THIS INDENTURE, made the day of May , nineteen hundred and seventy-one,
BETWEEN G. HARVEY MOIRE, residing at (No Number) Kirby Lane,
Jamesport, New York, and ROBERT R. LESLIE, residing at 191 West
Aldrich Road, Columbus , Ohio,

' party of the first part, and MICHAEL MASTROPOLO and JEAN MASTROPOLO, his wife,
both residing at 69 Lords Way, Manhasset Hills , New York,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of
SIXTY-EIGHT THOUSAND FIVE HUNDRED and 00/100 DOLLARS ($68,500.00) ,

by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,

bounded and described as follows :
BEGINNING at a point which marks the northwesterly corner of the
premises about to be described, which point is distant the following
two (2) courses and distances from a point where the division line
between land of G. Harvey Moore and Robert R. Leslie on the east and
land now or formerly of J. Cardinale on the west is intersected by the
southeasterly line of Peconic Bay Boulevard: (1) South 250 02 ' 50"
East 191.49 feet measured along said division line to a point at the
northwesterly corner of land of Frank J. Keller and wife; and
(2) North 630 461 East 91.99 feet along the northerly line of land
of Frank J. Keller and wife; running thence South 230 581 30" East
250.93 feet, more or less , along the easterly line of said land of
Keller to the approximate high water mark of Great Peconic Bay;
running thence along the approximate high water mark of Great Peconic
Bay on a tie line course and distance of North 330 08' 50" East
105 .99 feet, more or less, to land now or formerly of Gatehouse;
running. thence North 230 07 ' 50" West along last mentioned land
approximately 198 feet to a point which is North 63° 46' East 91.99
feet from the point of beginning; running thence South 63° 46' West
91.99 feet to the point of BEGINNING.
RESERVING to G. Harvey Moore and Robert R. Leslie and/or their heirs
and assigns ; and together with and subject to a right of way to be
used by Ge Harvey Moore, Robert R. Leslie and/or their heirs and
assigns , and by the grantees herein, their heirs and assigns , for
vehicles and other lawful uses , over the following-described right
of way, a portion of which is included within the bounds of the
above-described premises :
BEGINNING at a point on the Southeasterly side of Peconic Bay
Boulevard distant North 480 46 ' 50" East 92.15 feet when measured

along the Southeasterly side of Peconic Bay Boulevard from a point
here the Easterly side of land now or formerly of J. Cardinale inter-
sects the Southeasterly side of Peconic Bay Boulevard and from said
point of beginning running thence along the Southeasterly side of
econic Bay Boulevard North 480 46' 50" East 15 . 70 feet; running
thence South 23° 58 ' 30" East 260.11 feet; running thence South 66°
O1 ' 30" West 5 .00 feet; running thence South 23° 58 ' 30" East 190.93
feet; running thence South 33° 08 ' 50" West 5 .96 feet; running thence
North 230 58 ' 30" West 192.55 feet; running thence South 660 Ol' 30"
West 5 .00 feet; running thence North 230 58' 30" West 254.85 feet to
the Southeasterly side of Peconic Bay Boulevard at the point or place
of BEGINNING.
RESERVING unto the grantors for the use of G. Harvey Moore and
Robert R. Leslie, and/or their heirs and assigns , for beach purposes ,
of the foreshore area at the southwesterly corner of the premises
first above-described, which foreshore area is bounded and described
as follows :
BEGINNING at the southwesterly corner of the premises first above-
described; running thence along Great Peconic Bay North 330 08 ' 50"
East 22 .5 feet; running thence North 23° 58' 30" West 20.00 feet;
running thence South 330 08 ' 50" West 22.5 feet; running thence
South 230 58 ' 30" East 20.00 feet to the point or place of BEGINNING.
This conveyance is subject to the following restrictions which shall
be binding upon the grantees , their heirs and assigns , and which
shall run with the land:
1. No cabanas or other structures shall be erected on the
said foreshore area.
2. The cost of reasonable maintenance, snow removal and
repairs of the aforesaid right of way shall be shared equally by the
respective owners of the four parcels which bound said right of way.
3 . The grantors , G. Harvey Moore and Robert R. Leslie,
covenant and agree that their reservation of the right of way and
foreshore area is for the sole purpose of their granting use of said
right of way and foreshore area to the owners of the tour parcels
which bound said right of way, and the grantors covenant and agree
that they shall not grant any right whatever to the use of said right
of way and foreshore area to their heirs or assigns or to any third
persons , with the exception that said use shall be granted only to
the owners of the four parcels which bound said right of way.
TOGETHER with all the right, title and interest of the party of the
first part in and to so much of Great Peconic Bay as abuts the said
premises .
SUBJECT to a mortgage held by Robert L. Bergen and Helen K. Bergen,
dated September 17, 1966, recorded September 21, 1966 , in Liber 5031
mp 109 , which mortgage has a present principal balance of $29,600.00
with interest thereon from the date hereof, which mortgage the party
of the second part hereby assumes and agrees to pay.
