THIS INDENTURE, made the day of May , nineteen hundred and seventy-one, BETWEEN G. HARVEY MOIRE, residing at (No Number) Kirby Lane, Jamesport, New York, and ROBERT R. LESLIE, residing at 191 West Aldrich Road, Columbus , Ohio, :r ' party of the first part, and MICHAEL MASTROPOLO and JEAN MASTROPOLO, his wife, both residing at 69 Lords Way, Manhasset Hills , New York, party of the second part, WITNESSETH, that the party of the first part, in consideration of SIXTY-EIGHT THOUSAND FIVE HUNDRED and 00/100 DOLLARS ($68,500.00) , lawful money of the United States. RESERVING to G. Harvey Moore and Robert R. Leslie and/or their heirs and assigns ; and together with and subject to a right of way to be used by Ge Harvey Moore, Robert R. RESERVING unto the grantors for the use of G. Harvey Moore and Robert R. Leslie, and/or their heirs and assigns , for beach purposes , of the foreshore area at the southwesterly corner of the premises first above-described, which foreshore area is bounded and described as follows : BEGINNING at the southwesterly corner of the premises first above- described; running thence along Great Peconic Bay North 330 08 ' 50" East 22 .5 feet; running thence North 23° 58' 30" West 20.00 feet; running thence South 330 08 ' 50" West 22.5 feet; running thence South 230 58 ' 30" East 20.00 feet to the point or place of BEGINNING. This conveyance is subject to the following restrictions which shall be binding upon the grantees , their heirs and assigns , and which shall run with the land: 1. No cabanas or other structures shall be erected on the said foreshore area. 2. The cost of reasonable maintenance, snow removal and repairs of the aforesaid right of way shall be shared equally by the respective owners of the four parcels which bound said right of way. 3 . The grantors , G. Harvey Moore and Robert R. Leslie, covenant and agree that their reservation of the right of way and foreshore area is for the sole purpose of their granting use of said right of way and foreshore area to the owners of the tour parcels which bound said right of way, and the grantors covenant and agree that they shall not grant any right whatever to the use of said right of way and foreshore area to their heirs or assigns or to any third persons , with the exception that said use shall be granted only to the owners of the four parcels which bound said right of way. TOGETHER with all the right, title and interest of the party of the first part in and to so much of Great Peconic Bay as abuts the said premises . SUBJECT to a mortgage held by Robert L. Bergen and Helen K. Bergen, dated September 17, 1966, recorded September 21, 1966 , in Liber 5031 mp 109 , which mortgage has a present principal balance of $29,600.00 with interest thereon from the date hereof, which mortgage the party of the second part hereby assumes and agrees to pay.
