WITNESSETH, that the party of the first part, in consideration ofTen Dollars and
other val uable consideration paid by the party of the second part, does hereby grant
and release unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever, all of the party of the first part's interest in
ALL that certain plot, piece or parcel of land, with buildings and improvements
thereon erected, situate, lying and being at Peconic, Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:
BEGINNING at a post set in the northerly side of Main Road at the southeasterly
corner of the premises herein described and which said point is also in the
southwesterly comer of land now or formerly of Stanley Mokus;
RUNNING THENCE South 42" 06' West along the northerly side of Main Road, a
distance of 69.42 feet to a monument and land now or formerly of S.B. Berkoski:
THENCE North 42" 27' West along last mentioned lands a distance of 123.0 feet to
a monument and land now or formerly of George Berkoski;
THENCE the following two courses and distances along last mentioned lands:
I. North 42" 27' West a distance of 55.0 feet to a monument;
2. South 43" IS' SO" west a distance of 192.19 feet to a monument and land now or
formerly of A. Reinhart;
THENCE the following two courses and distances along last mentioned lands:
I. North 37" 54' West a distance of 45.00 feet to a monument;
2. South 49" 54' West a distance of 188.80 feet to a monument and lands now or
formerly of L.A. Gozelski;
THENCE the following two courses and distances along the last mentioned lands:
I. North 39" 00' 10" West thru a monument a distance of 953.80 feet to a
monument;
2. South 36" 5 I' 20" West a distance of 470.47 feet to a monument and land now
or formerly of Inez M. Quinn:
THENCE North 51" 57' 20" West along last mentioned lands a distance of 509.55
feet to a monument and the southerly side of Carroll A venue;
THENCE North 38" 20' East along the southerly side ofCaroll Avenue a distance
of 16.40 feet to a monument and lands now or formerly of William Buckingham

Excepting so much as was conveyed by FRANK CICHANOWICZ by deed dated
March 13, 1986 and recorded May 19, 1986 in Liber 10040 page 122 (Exhibit A
attached hereto).
PREMIS..::S ALSO KNOWN AS 43635 Rte. 25. Peconic, New York
BEING AND INTENDED TO BE a portion of the same premises conveyed to the
party of the First part by deed dated April 3, 2007 and recorded in the Suffolk
County Clerk's Office on S/~/'1 in Libe~age 710 .
Together with all right, title and interesl, if any, of the party of the first part in and
to any streets and roads abulling the above-described premises to the center lines
thereof:
Together with the appurtenances and all the estate and rights of the pany of the first
pan in and to said premises;
To have and to hold the premises herein granted unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever.
And the party of the first pan covenants Ihat the party of the first part has not done
or suffered anything whereby Ihe said premises have been encumbered in any way
whatever. except as aforesaid.
And the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this
conveyance and will hold the right to receive such consideration as a trust fund to
be applied first for the purpose of paying the cost of improvement and will apply the
same first to the payment of the cost of the improvement before using any part of
the lotal of the same for any other purpose. The word 'party. shall be eonslrued as
if it read "parties" whenever the sense of this indenture so requires.
In Witness Whereof, the party of the first part has duly executed this Deed the day
and year first above wrillen.
