SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under me Type II category of the State's List of Actions,
without further steps under SEQRA.
PROPERTY FACTS/DESCRIPTION: The applicant's 40.000 square foot parcel is a conforming lot in the R-40
Low-Density Residential Zone District. The ,roperty has 195 feet along the west side of Breakwater Road
(Luthers Road) and a depm of 200 feet, and s improved with a single-family dwelling as shown on the April
13, 2007 survey prepared by Joseph A. Ingegno..
BASIS OF APPLICATION: Request for a Variance under Section 280-124, based on the Building inspector's
January 30, 2007 Notice of Disapprova~ concerning an application for a building permit to construct additions
ana alterations to the existing dwelling, for the reason that the new construction will be less than the code-
required mimmum of 15 feet on a single side yara.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on May 31, 2007, at which time written
and oral evidence were [~resented. Basec upon all testimony, documentation, personal inspection of the
property, and other evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct a 15 ft. wide by 32 ft. deep, one-
story addition at the south side of their existing dwelling, after remova of the as-built frame shed presently in a
nonconforming s~oe yard location. The addition is proposed 13.4 feet from the southerly side lot line, and is
proposed to be meet codes in all other resoects for an accessory home office.
ADDITIONAL INFORMATION: An as-built 8 x 10 shed that exists in a nonconforming side yard location will
be relocated to a conforming location, as confirmed by the applicant's attorney letter received by the ZBA May
9, 2007, and its nonconforming location is not requested by applicant in this variance application.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a
detriment to nearby properties. The applicant's home has existed in this location for over 20 years. The
applicant's driveway is located on the northeast corner of the property and the landscaping is extensive as

established. The addition is based on the design of the dwelling and will be proportional at one-story,
compared t° the size and design of the existing dwelling.
2. The benefit sOught by the applicant cannot be achieved by some method, feasible for the applicant to
pursue, other than an area variance. A sanitary system and landscaped driveway areas are located in the
front yard and in-ground swimming pool in the westerly yard.
3. The variance granted herein is not substantial. The reduction is 10% of the code requirement, for the
requested 1.6 ft. setback reduction.
4. The difficulty has not been self-created.
5. No evidence has been submitted to suggest that a variance in this residential community will have an
adverse impact on the physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy
the benefit of an addition, while preserving and protecting the character of the neighborhood and the health,
safety and welfare of the community.
RESOLUTION OF THE BOARD: In cOnsidering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Oliva, and duly
carried, to
GRANT the variance as applied far, as shown on the April 13, 2007 survey prePared by Joseph A.
Ingegno and the March 23, 2007 Construction Plan A-1 prepared by Richard Ebert.
Any deviation from [he variance given such as extensions, or demolitions which are not shown on the
applicant's diagrams or survey site maps, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future use,
setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that
does not increase the degree of nonconformity.

Part A: AREA VARIANCE REASONS (attach extra sheet as needed):
(1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a
detriment to nearby properties if granted, because:
Dr. Emanuele wishes to construct a one story extension for a home office. The existing
house is situated closer to the southerly property line and the only location available for the
expansion is on the south side. The addition is designed to match the existing roof line and
living area of the existing house.
(2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the
applicant to pursue, other than an area variance, because:
The owner consulted with a design professional, Richard Ebert PE and the final conclusion
was that the proposed location of the addition can only be located where proposed.
(3) The amount of relief requested is not substantial because:
The required setback is 15' but the proposed is 13.6'. The rear of the house contains a
swimming pool and the front of the house contains the sanitary system. The addition
provides privacy and could be adapted for elderly parents.
(4) The variance will NOT have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or district because:
The living area of the existing house is less than 2,000 sq.ft., the lot coverage is less than
6%. The addition is proportional to the size of the existing house.
(5) Has the variance been self-created? (X)Yes, or ( )No. If not, is the construction
existing, as built? ( )Yes, or (X)No. However, the house was constructed by the prior
owner and placed closer to the south side of the property. The addition would be
unattractive if located on the two story north side of the house.
(6) Additional information about the surrounding topography and building areas that relate to
the difficulty in meeting the code requirements: (attach extra sheet as needed). The survey
shows the location of other structures on the property and the elevations show the design of
the existing house. This small one story addition will maintain the character and
architecture of the existing house.
This is the MINIMUM that is necessary and adequate, and at the same time preserves and
protects the character of the neighborhood and the health, safety, and welfare of the
community.
