(2) It shall not be obstructed in any way and the maintenance thereof shall be the joint responsibility of all those having a right to use said right of way for the time being. (3) Said easement shall be perpetual and shall run with the land but no easement or rights in said right of way shall vest in the general public. It shall be a private right of way.
