THIS INDENTURE, made the 9 r day of October nineteen hundred and seventy-three
BETWEEN
CHARLOTTE B. A. FINNEY, residing at (no number) West Cove Road,
Nassau Point, New York,
party of the first part,and
HILARY A. PRIGDEN, residing at 110 Atherton Avenue, Atherton,
California
party of the second part,
WITNESSETH,that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,

follows:
COMMENCING at a monument set in the southerly line of Peconic Bay
Boulevard which monument is located the following two courses and
distances from the extreme southerly end of a curve connecting the
westerly line of Wendy Drive with the northerly line of Peconic
M Bay Boulevard: (1) South 50 degrees 03 minutes 50 seconds East,
a distance of 50.38 feet to a monument; and- (2) South ,50 degrees
59 minutes 00 seconds West, a distance of 1412,40 feet to a point;
and from said point or place of beginning running thence South
28 degrees 11 minutes 50 seconds East, a distance of 573. 79 feet
to the high water mark of Peconic Bay; thence along the high water
cc mark of Peconic Bay along a tie line bearing South 45 degrees 35
minutes 35 seconds West, a distance of 98. 61 feet to a point,
thence North 32 degrees 41 minutes 35 seconds West through two
monuments a distance of 576. 34, feet to the southerly line of
Peconic Bay Boulevard and a monument; thence North 50 degrees
59 minutes 00 seconds East, a distance of 142.40 feet to the
point or place of BEGINNING.
TOGETHER WITH all the right, title and interest of the party
of the first part of, in and to the beach, strand, shore
front and waters beneath Peconic Bay.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indentpre so requires.
