Form 8002-2-73—Bargain and Sale Deed with Covenant against Grantor's Acts—Individual or Corporation (single sheet) CONSULT YOUR LAWYER BEFORE SIGNING THIS INSTRUMENT—THIS INSTRUMENT SHOULD BE USED BY LAWYERS ONLY. eTHIS INDENTURE,made the /J_ day of March nineteen hundred and seventy—four nIBETWEEN GERARD GOEHRINGER AND HELEN GOEHRINGER, his wife , both �I residing- on Sigsbee Road, Mattituck, County of Suffolk and Iry State of New York party of the first part, and HELEN GOEHRINGER, residing on Sigsbee Road, Mattituck, County of Suffolk and State of New York Ic r , party of the second part, VX WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable con- sideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situ- ate, lying and being imake at Mattituck in the Town of Southold , County of Suffolk and State of New York, Known and designated as and by lot number 46 on a certain map entitled "Map of Property of Mattituck Park Proper- ties, Inc. , Mattituck, , N.Y. made by Daniel R. Young Surveyor and which said map is on file in the office of the Clerk of the County of Suffolk. TOGETHER with the right to said parties of the second part and the heirs and assigns of the parties of the second part to use in common with the other owners of lots shown on said map, the tract shown on said map as Sigsbee Park for park purposes, under such conditions, limitations and restrictions as the Mattituck Park Properties, Inc. may impose. Such use to be such as in the unrestricted judgment of the Mattituck Park Properties , Inc . will not unreasonable interfere with the use and enjoyment of said Sigsbee Park by the owners of lots on said map. TOGETHER with a right of way over Sigsbee Road shown on said map and over right of way three rods wide running from Peconic Bay Boulevard over premises shown on said map , to Peconic Bay, SUBJECT to any state of facts an accurate survey may show. SUBJECT to covenants, restrictions, reservations and easements of record. TOGETHER with all right. title and interest, if any, of the party of the first part of, in and to any streets anti roads abutting the above-described premises to the center lines thereof; TOGETHER with the appur- tenonc�s and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such con- sideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party"shall be construed as if it read "parties" whenever the sense of this indenture so requires.
