FLISS and MARILYN FLISS, his wife, residing at 465 Horton Avenue, Mattituck, County of Suffolk, New York. party of the second part, I / WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, { ALL that certain plot; piece or parcel of land, with the buildings and improvements thereon erected, situate, {;J lying and being in the Town of Southold, County of Suffolk and State of New York, at Laurel, bounded and described as follows: BEGINNING at a monument on the easterly line of Bray Avenue, 100.0 feet northerly along said easterly line and its extension southerly from the extension westerly of the northerly line of Albo Drive; said point of beginning being the southwesterly corner of other land of the party of the second part, from said point of beginning running along said land of the party of the second part North 69° 13 ' 10" East 205. 74 feet to :a monument; thence along land of the party of the first part South 160 13' 10" West 125.22 feet to said northerly line of Albo Drive; thence along said northerly line of Albo Drive South 69° 13 ' 10" West 105. 38 feet; thence northwesterly on a curve bearing to the right having a radius of 25. 0 feet a distance of 39.27 feet to said easterly line of Bray Avenue; thence along said easterly line of Bray Avenue North 20° 46 ' 50" West 75. 0 feet to the point of beginning. TOGETHER with the privilege in common with others to use a right of way leading from the Boulevard, so called, to Peconic Bay, which privilege is contained and recited in deed to Georgia I. Tuthill et al dated April 17, 1928 and recorded August 13, 1928 in Suffolk County Clerk' s office in Liber 1368 of Deeds, at Page 24. SUBJECT to the covenants and restrictionsif any, affecting said premises. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
