BURNS , residing at 280F Berwick Court, Ridge, New York, party of the first part,and ALBERT A. BRISOTTI, JR, and FLORENCE C. BRISOTTI, his wife, both residing at Peconic Bay Boulevard (no number) , Laurel, New York, party of the second part, WITNESSETH,that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part,the heirs CD or successors and assigns of the party of the second part forever, ,4 ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being ixtx at Laurel, Town of Southold, County of Suffolk and State of New York, bounded and described as follows: I BEGINNING at a point on the northwesterly side af_,.Eeconic Ray -. 4 � as Boulevard distant 450 feet southwesterly from the intersection of the southwesterly line of land of George J. Turner with the e northwesterlyside of Peconic Bay Boulevard; running thence LLalong the northwesterly side of Peconic Bay Boulevard, South 39 CC degrees 46 minutes 30 seconds West 70 feet; thence North 50 degrees 13 minutes 30 seconds West 95 feet; thence North 39 degrees 46 minutes 30 seconds East 70 feet; thence South 50 degrees 13 minutes 30 seconds East 95 feet to the northwesterly side of Peconic Bay Boulevard, the point or place of BEGINNING. TOGETHER with a right of way from Peconic Bay Boulevard to Peconic Bay for foot passage only and for bathing purposes as more fully described in the deed dated March 19, 1952 recorded in Liber 3334 cp 320 in the Office of the Clerk of the County of Suffolk. BEING AND INTENDED to be the same premises conveyed to the party of the first part by deed of Robert Zajic dated June 2, 1970, and recorded in the Office of the Clerk of Suffolk County at Liber 6751 of Conveyances at Page 496 on June 4, 1970. SUBJECT TO an existing mortgage with the Riverhead Savings Bank with a balance of $6,211.77. This is a correction deed to add a right-of-way to Peconic Bay for foot passage which was omitted by deed dated 9/18/73 and recorded 9/21/73 in Liber 7494 cp 561. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the fast part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
