ALL that certain plot, piece or panel of land, with the buildings and improvements thereon erected, situate, lying and
being+n~h~ at Peconic, in the Town of Southold, County of Suffolk and
State of New York, known and designated as Lots Numbered 104 and 105,
on a certain map entitled, "Map No. 2 of Peconic Shore, Peconic,
L.I.N.Y., property of B.B. Bailey and C.H. Bailey", D.R. Young,
Surveyor, Riverhead, N.Y. and filed in the Suffolk County Clerk's
Office on September 15, 1930 as Map No. 654, which said lots are
more particularly bounded and described as follows:
i~ BEGINNING at a point on the westerly side of Burtis Place,
distant 437.79 feet northerly- from the corner formed by the
intersection of the westerly side of Burtis Place and the northerly
side of Fasbender Avenue; thence South 54° 33' 30" West 130.74 feet;
thence North 29° 46' 20" West 90.44 feet; thence North 54° 33' 30"
East 137.98 feet to the westerly side of Burtis Place; thence South
25° 15' 20" East along the westerly side of Burtis Place 91.42 feet
to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party
of the first part by deed dated October 1998 and recorded in the
Suffolk County Clerk's Office on December 22, 1998 in Liber 11935
Page 564 and by deed dated June 3, 1987 and recorded in the Suffolk
County Clerk's Office on June 9, 1987 in Liber 10337 Page 448.
TOGETHER with all right, title and interest, if any, of the party of the first pm't, in and to any streets and roads
abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second part lbrever.
AND the part of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consider-
ation as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
