Tuthill and others , situate at Laurel, Town of Southold, NY” surveyed March 28 , 1928, by Otto W. Van Tuyl, Greenport New York, Surveyor, and filed in the office of the Clerk of Suffolk County of January 15, 1929 , as Map No. 861. l O TOGETHER with all the right, title and interest of the parties of the first part of, in and to roads, streets or avenues adjacent c to said premises to the center lines thereof. J TOGETHER with the privilege in common with others to us a right of way leading from the Boulevard, so called, to Peconic Bay, 4 which said privilege is contained and recited in deed to George I . Tuthill et al, from Frank Bray et al. dated April 17 , 1928 , and recorded August 13, 1928 in Liber 1368 of Deeds, page 24 . BEING the same premises described to the parties of the first o part herein by deed dated August 2 , 1958, which deed was recorded p at the Suffolk County Clerk' s Office in Liber 4495 cp. 70 on August 5, 1958. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- �1• eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply 1 the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
