MARCHESI and NANCY T. MARCHESI, his wife, residing at 1 Baylis Place, Syosset, New York, 11791 party of the first part, and DAWN POLEWAC residing at 121 Groh.mans Lane, Plainview, Long Island,New York BOCK LOT OIgTFtICT u.i.�++r' SECTION � � party of the second part, ae '� Q 17 WITNESSETH, that the pa IIy of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Village of Laurel, Town of Southold, County of Suffolk, being part of Lots No. 4 and 5 and a private road on a "Map of Elizabeth Mesrobian—Forest Hills Improvement Co.".,filed in the Suffolk County Clerk's Office as Map 1381, and more particularly described as follows: BEGINNING at a monument on the easterly line of a 20 foot private road leading southerly from Peconic Bay Boulevard, said point of beginning being South 20 degrees 07 minutes East 228.68 feet along said easterly line from a point on the southerly line of said Peconic Bay Boulevard about 1860 feet easterly along said southerly line from Laurel Lane; said point of beginning being the southwest- erly corner of land of Theo. Fleschutz; from said point of beginning. RUNNING along said land of Fleschutz, North 75 degrees 45 minutes 40 seconds East 193 feet, more or less, to ordinary high water mark of Brush's Creek; THENCE southerly along a tie line which marks the ordinary high water mark of Brush's Creek South 2 degrees 39 minutes East 91.26 feet to lands of Jenney Seeth; THENCE along said land of Seeth, South 83 degrees 00 minutes West 169.0 feet, more or less, to said easterly line of said 20 foot private road; THENCE North 20 degrees 07 minutes West along the easterly side of said 20 foot private road 68.47 feet to the point of BEGINNING. SAID PREMISES known as Mesrobian Drive, Laurel,New York. PREMISES are the same as those described in Liber 9057 pg471, to the grantors herein. TOGETHER with all right, tide and interest, if any, of the parry of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the parry of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party' shall be construed as if it read "parties" whenever the sense of this indenture so requires.
