Franceschini having died on April 6, 1979.

SUBJECT TO a purchase money mortgage in the sum of $37, 000.00
3/ TOGETHER WITH a Right of Way over a strip of land along the shore from
beyond Lots Nos. One to Four (1-4) , both inclusive, for the purpose of
boating, bathing and- outdoor sports and for ingress to and egress from
the waters of Pecohic Bay, said easement as set forth in Liber 1654,
Page 49, as shown on filed map of "Laurel Park" filed October 5, 1925,
as Map No. 212, Town of Southold.
TOGETHER with all right, tide and interest, if any, of the parry of the first part in add to any street( and
roads abutting the above described premises to the anter limn thereof; TOGETHER with the appurtenances and
all the estate and rights of the parry of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the parry of the second put, dne heirs or successors and assigns of the parry of the
second part forever.
AND the parry of the first put covenants that the parry of the fust part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever,accept as aforesaid.
AND the parry of the fust part in compliance with Section 13 of the Lien Law,covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied fust for the purpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using any part of the total of the now for any other purpose.
The word "parry" shall be construed as if it rad "parties" whenever the tense of this indenture so requires.
