Witnesseth, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by
the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors
and assigns of the party of the second part forever,
All thatcertain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and
beingixxtsx at Mattituck, Town of Southold, County of Suffolk and State
of New York, more fully bounded and described as follows:
BEGINNING at a point on the southerly line of Peconic Bay Boulevard, lo-
cated at the point of intersection of the westerly line of land, now or
formerly of J. Holfelder, formerly of Robert W. Wells, with the southerly
line of Peconic Bay Boulevard, and from said point of BEGINNING
RUNNING THENCE South 22 degrees, 33 minutes 40 seconds east, along land
now or formerly of J. Holfelder, formerly of Robert W. Wells, 370.42 feet
to the mean high water mark of Peconic Bay;
RUNNING THENCE along a tie line along the mean high water mark of Peconic
-Bay,South 40 degrees, 23 minutes, 50 seconds west, 157,.56 feet to a point
at the intersection of the easterly line of land formerly of J. Tuthill,
now or formerly of McGowan with the high water mark of Peconic Bay;
RUNNING THENCE North 21 degees, o6 minutes, 10 seconds west, along land
formerly of J. Tuthill now or formerly of McGowan 397.26 feet, to the
southerly line of Peconic Bay Boulevard;
RUNNING THENCE North 48 degrees 23 minutes 50 seconds east, along the
southerly line of Peconic Bay Boulevard 137.77 feet to the point or
place of BEGINNING.
SAID PREMISES being and intended to be the same as conveyed to the parties
of the first part by deed dated February 26, 1983 and recorded in the
office of the Clerk of the County of Suffolk on March 9, 1983 at liber
9324 cp. 372.
Together with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting
the above described premises to the center lines thereof; Together with the appurtenances and all the estate and
rights of the party of the first part in and to said premises; To Have And To Hold the premises herein granted unto the
party of the second part, the heirs or successors and assigns of the party of the second partforever.
And the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever, except as aforesaid.
And the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part
will receive the consideration forthis conveyance and will hold the right to receive such consideration as a trust fund
to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment
of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
In Witness Whereof, the party of the first part has duly executed this deed the day and year first above written.
