second part, does hereby grant and release unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in tbK Laurel, Town of Southold, County of Suffolk, State of
New York, described as follows :
PARCEL I
Commencing at a monument set in the northerly side of Great
Peconic Bay Boulevard , which monument is 169.73 feet west of another
monument set in the northerly side of said Boulevard at the south-
easterly corner of lands now or formerly of Carlton M. Prankard where
the same adjoin lands formerly of VanBrunt Tandy (the distance 169.73
feet being measured along the northerly side of Great Peconic Bay
Boulevard) , thence North 41 " 36' 10" West 200 feet to a point; thence
South 48" 23 ' 50" West 100 feet to a point; thence South 41 " -. 36 ' 10"
East 200 feet to the northerly side of Great Peconic Bay Boulevard;
thence North 48" 23 ' 50" East 100 feet by and along the northerly
side of Great Peconic Bay Boulevard to the point or place of begin-
ning .
Together with all the right, title and interest of the
party of the first part in and to lands lying within the bounds of
Great Peconic Bay Boulevard adjacent to said premises to the center
line thereof.
Together with the right in common with Carlton M. Prankard
and Lillian Prankard , their heirs, assigns, lessees and grantees to
use the twelve (12) foot reserved right of way described in deed from
Carlton M. Prankard and Lillian Prankard to William F. Higgins and
Edward H. Stoehr, dated April 27 , 1929 , recorded in Suffolk County
Clerk' s office on May 2 , 1929 in liber 1429 of deeds at page 448 , to
pass from Great Peconic Bay Boulevard to the waters of Great Peconic
Bay subject to the condition that said right of way shall not be used
for commercial purposes at any time.
Subject to the following covenants, conditions and restric-
tions , which run with the land and are binding on the parties of the
second part, their heirs , assigns and distributees :

1 . The premises shall be used for residential purposes
my and no business of any kind shall be conducted there. Business
is intended to include rooming or boarding houses.
2 . No house or building of any kind shall be erected ,
constructed or moved upon any part of said premises so as to bring
the nearest line of such building or structure nearer to the east or
est line of said plot than ten ( 10) feet.
Being and intended to be the same premises conveyed to
Wilbur J . July and Eleanor A. July by deed dated February 3 , 1937
from Carlton M. Prankard and Lillian Prankard recorded on February 4 ,
1937 in the Suffolk County Clerk' s office in liber 1967 of deeds at
page 340.
PARCEL II
Commencing at a monument set in the northerly side of Great
Peconic Bay Boulevard, which monument is 169 .73 feet west of another
monument set in the northerly side of said Boulevard at the southeast
corner of lands of Carlton M. Prankard, where the same adjoin lands
formerly of Van Brundt Tandy, as measured along the northerly side of
Great Peconic Bay Boulevard; running thence north 41 " 36 ' 10" west
250 feet through a monument to a point and other lands of the parties
of the first part ; running thence south 48" 23 ' 50" west by and along
other lands of the parties of the first part 200 feet to a point;
running thence south 41 " 36 ' 10" east 250 feet through a monument to
a monument set on the northerly line of Great Peconic Bay Boulevard;
running thence north 48° 23 ' 50" east by and along the northerly line
of Great Peconic Bay Boulevard 200 feet through a monument to a monu-
ment at the point or place of beginning.
Together with all the right, title and interest of the
party of the first part , of, in and to land lying within the bounds
of Great Peconic Bay Boulevard adjacent to said premises to the
center line thereof.
Excepting therefrom , however, that portion of the above
described premises as were previously conveyed by Carlton M. Prankard
nd Lillian Prankard , his wife , to Wilbur J . July and Eleanor A.
July, his wife , by deed dated February 3 , 1937 , recorded February 4 ,
1938 in Suffolk County Clerk' s office in Liber 1967 of Deeds at page
40.
Together with the right, in common with Carlton M. Prankard
and his successors , assigns , and grantees to use the twelve (12) foot
eserved right of way described in deed from Carlton M. Prankard and
Lillian Prankard to William P. Higgins and Edward H. Stoehr, dated
April 29 , 1929 , recorded in Suffolk County Clerk' s office on May 2 ,
1929 in Liber 1429 of Deeds at page 448 to pass from Great Peconic
Bay Boulevard to the water of Great Peconic Bay , subject to condition
that said right-of-way shall not be used for commercial purposes at
any time and subject to the following covenants and restrictions

M. Prankard , recorded July 26 , 1941 in the Suffolk County Clerk' s
office in Liber 2177 of deeds at page 99.
This deed is confirmatory of the devise of the two above
described parcels to the parties of the second part as all of the
residuary beneficiaries under Article FIFTH of the Last Will and
estament of Eleanor A. July , dated April 8 , 1981 , and admitted to
robate on November 28 , 1983 in the Suffolk County ,;: Surrogate Court
