WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,

point or place of BEGINNING.
TOGETHER WITH an easement and right-of-way for purposes of
ingress and egress between said premises and Old Harbor Road over a
10 foot in width strip of land of premises immediately adjoining on
the east of the premises herein described for persons, vehicles and
animals and for utility purposes to be used in common with the suc-
cessors and assigns of James C. Whelan and Elizabeth F. Whelan and
present and future owners of any property abutting on said right-
of-way and their guests and subject to a like easement and right-
of-way over the easterly 10 feet of the premises described herein
in favor of the successors and assigns of James C. Whelan and
Elizabeth F. Whelan and present and future owners of any property
abutting on said right-of-way and Aheir�guests.

G; dated April 28 , 1955 and recorded in the Suffolk County Clerk' s
r� Office on May 25 1955 in Liber, 3892 at Page 468 , of which the party
C111ofthe first part is the surviving spouse of James C. Whelan who
died a resident of Nassau County on September 16, 1964.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
.AND the party of the first part covenants that the party of the first part has not done or suffered an,ihing
Whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the ]arty of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this comeyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the irnproveenent before using any part of the total of the same for
any other purpose. _ - -
