WITNESSETH, that the party of the first part, in consideration of TEN and no/100 ($10. 00)---

lawful money of the United States, and other good and valuable consideration paid
by the party of the second part, does hereby grant and'release unto the party of the second part, the heirs or
1 successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being imribx at New Suffolk, Town of Southold, Suffolk County, New York,
bounded and described as follows:
BEGINNING at a point on the southwesterly side of Old Harbor Road at the
northwesterly corner of land conveyed by Harry H. Tuthill, the party of the first
part herein, to J. Katherine Tuthill by deed dated September 22, 1972 and
recorded in the Suffolk County Clerk's Office on April 6, 1973 in Liber 7374 of
deeds at page 113; from said point of beginning running thence along the south-
westerly line of Old Harbor Road North 46 degrees' 18 minutes 30 seconds West
100 feet to land now or formerly of Lundin; running thence in a southwesterly
direction along said land of Lundine 115 feet, more or less, to a canal;
running thence in a southerly or southeasterly direction along said canal 100
feet, more or less, to said land of J. Katherine Tuthill, running thence in a
northwesterly direction along said land of J. Katherine Tuthill, 150 feet, more
or less, to said southwesterly line of Old Harbor Road and the point or place of
beginning.
THE PARTY of the second part, her heirs, executors, administrators and
successors shall have a right of way and free access to all of the canals in the
Harry H. Tuthill Property, known also as School House Creek Association, and
to have the sole use of fifteen (15) feet in the canal, in front of and adjacent to
the premises herein conveyed to maintain landings, docks and spiles; the party
of the second part, and her grantees or successors in interest to leave a right
of way for vessels to come and go freely of at least a thirty foot channel in the
middle of the canal.
SAID PARTY of the second part, for herself, her grantees or her successors
in interest agrees to pay a pro rata share with all other owners, grantees and
lessees of the School House Creek. Property of the cost of maintaining at all
times four feet of water at low tide in the canals. Said prorata share to be based
on the canal frontage of the party of the second part, and at the fair market price
per cubic yard for such work, all of which relates to the thirty foot channel and
excludes the fifteen feet adjacent to owners and lessees of canal frontage, reserved
to owners and lessees.
