\1BEGINNING at an iron pipe on the easterly line of a 33 foot
ight of way over land of the party of the first part at the north-
esterly corner of land of Mason; said point of beginning being,
. 43° 41' 30" W. 225.97 feet and thence S. 29° 52' 40" E. 122.75
eet along said right of way from Old Harbor Road; from said point

017 TOGETHER with a right of way 33 feet in width from said Old
048arbor Road southwesterly and then southerly to the southwesterly
orner of the premises for access in common with others between said
premises and Old Harbor Road together with an easement for driving
and maintaining a well, installing and maintaining pumping equipment
V in the pump house on other premises of the party of the first part
approximately 150 feet southwesterly of Old Harbor Road and for
laying and maintaining a water main from said pump house northerly to
the 33 foot right of way running southwest from Old Harbor Road along
said right of way southerly, then southeasterly to the premises, said
water main to be at least two (2) feet underground.
The party of the second part, for themselves, their heirs, ex-
ecutors, administrators, grantees and successors shall have a right
of way and. free access to all of the canals in the Harry H. Tuthill
property known also as School House Creek Association and agrees to
pay a pro rata share with all other owners, grantees, and lessees of
the School House Creek property of the costs of maintaining at all
times four feet of water at low tide in the canals. Said prcr rata

share to be based on the canal frontage of the party of the second
part, and at the fair market price per cubic yard for such work.
BEING.AND INTENDED TO BE the same premises conveyed to the party
of,.-the first part by Harrington H. Tuthill, and Harry H. Tuthill
byideed dated 'July 311, 1964 recorded at the Suffolk County Clerk' s
Office at Liber 5596 page 239.
PARCEL II
BEGINNING at a point marked by an iron pipe monument on the
easterly side of a certain right-of-way (hereinafter referred to as
"First-Right-of-Way,") , which right-of-way runs in a course North
290 52' 40" West and ends forty-one (41) feet from the northerly
side of Canal Number One said forty-one (41) feet being measuredalong
a line which runs in a course North 29" 52' 40" West; from said north-
erly side of Canal Number One, (Said iron pipe monument being distant
One Hundred and Fifty-Seven and sixteen hundredths (157.16) feet
measured along the course of the easterly side of said "Right---
from the northwesterly side of another Right-of-Way, which leads south-
westerly in a course South 43" 41' 30" West and at right angles from
Old Harbor Road; running thence from said iron pipe monument, on a
bearing South 87" 55' East One Hundred and Ten (110) feet to a point
located in Canal Number Two, on the westerly side of said Canal; run-
ning thence along the westerly side of Canal Number Two, the line of
said side being on a bearing South 29" 52 ' 40" East seventy-five (75)
feet; running thence in a course North 87" 55' feet West, a distance
of one hundred and ten (110) feet to the easterly side of said "First
\i Right-of-Way," ; and running thence Northwesterly in a course North
29° 52' 40" West, seventy-five (75) feet along the easterly side of
said "First Right-of-Way" to the point or place of BEGINNING.
TOGETHER with the free right at all times to enter upon and pass
over by foot, automobile, conveyance or otherwise, two (2) certain
rights-of-way, the first of which is the "First Right-of-Way" herein-
above mentioned, said "First Right-of-Way" being thirty-three (33)
feet in width, running in a course South 43" 41' 30" West and at
right angles from Old Harbor Road, to them, their heirs, executors,
administrators and assigns forever.
TOGETHER with all rights-of-way, easements and privileges, and
subject to all covenants, restrictions, and agreement as contained in
deed from Harry H. Tuthill, Julia M. Tuthill, and Rhoda E. Tuthill,
to Carolyn A. Roache, as Executrix of the Last Will and Testament of
J. Benedict Roache, deceased, dated August 24, 1931 and recorded in
the Suffolk County Clerk's Office on September 12, 1931 in Liber
1602 of deeds, page 457.
BEING AND INTENDED TO BE the same premises conveyed to the party
of the first part by Fritz C. Rohn and Anna E. Rohn by deed dated
January 25, 1972 recorded at the Suffolk County Clerk's Office at
Liber 7097 page 352
