and State of New York, bounded and described as follows:
BEGINNING at a point on the Easterly side of New Suffolk Road
where the same is intersected by the Southerly side of land now or
? formerly of Scott; and running thence along said land now or formerly
of Scott the following 3 courses and distances: (1) South 75 degrees

Suffolk Road; thence North 7 degrees 03 minutes 10 seconds East along
the Easterly side of Hew Suffolk Road 54.07 feet to the point or
place of beginning.
{ The Party of the Second Part, his heirs, executors, administrators
and successors shall have a right-of-way and free access to all of
the canals in the Harry H. 'Tuthill Property, known also as School
House Creek Association, and to have the sole use of fifteen (15)
feet in the said dredged canal in front of and adjacent to the prem-
ises herein conveyed to maintain landings and docks; the Party of the
Second Part and his grantees or successors in interest to leave a
right-o£-way for vessels to come and go freely of at least a thirty
(30) foot channel in the middle of the said dredged canal.
Said Party of the Second Part for himself, his grantees or his
successors in interest agrees to pay a pro rata share with all other
owners, grantees, and lessees of the .School House Creek Property
of the cost of maintaining ab all tines four (4) feet of water at
low tide in the canals. Said pro rata share to be used on 'the canal
frontage of the Party of the Second Part and at the fair market price
per cubic yard for such work, all of which relates to the thirty
(30) foot channel and excludes the fifteen (15) feet adjacent to
owners and lessees of canal frontage, reserved to ovmers and lessees.
With respect to the aforesaid right of way of a j0 foot channel
in the middle of the canal, it is understood that any landings or

docks that may presently encroach -.,.pon the said right of way/may
remain in their present position for five years from the date hereof.
