WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable em,
sideration paid by the party of the second part, does hereby grant and release unto the party of the
Bsecond part,the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and im rowntents thereon erected,
situation,lying and being in the Town of Southold, County of Suff olk and State
of New York, bounded and described as follows:
BEGINNING at a point in the Easterly line of Third Street distant
233.28 feet Southerly from the corner formed by the intersection of the
Easterly line of Third Street with the Southerly line of Jackson Street;
RUNNING THENCE North 87 degrees 21 minutes 00 seconds East along
I� land now or formerly of Pugsley 90 feet to a pipe;
THENCE South 5 degrees 00 minutes West still along land now or
formerly of Pugsley 100 feet to a nail in the bulkhead;
THENCE continuing the same course South 5 degrees 00 minutes
West still along said land now or formerly of Pugsley 30 feet to the
ordinary highwater mark of Peconic Bay;
THENCE Easterly along said highwater mark to the Easterly line
of Third Street, the tie line of the last course being North 86
degrees 16 minutes 20 seconds West 89.22 feet;
THENCE North 5 degrees 00 minutes East along the Easterly line
of Third Street 20 feet to a nail in the bulkhead; and
THENCE North 5 degrees 00 minutes East still along the Easterly
line of Third Street 100 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE all of the same premises described in a
certain Deed made by ROBERT EMERSON LOTZ, ROBERT EVERETT LOTZ and
RICHARD EMERSON LOTZ to SUSAN V. PUGSLEY, the party of the first part
herein, dated November 3, 1954 and recorded in the Suffolk County
Clerk's Office on November 8, 1954 in Liber 3786 of Deeds, at page 438.
SUBJECT to any state of facts that an accurate survey may shown.
TOGETHER with all right,title and interest, if any,of the party of the first part in and to any streets
and roads abutting the above described premises m the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the p of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto thepartyof the second part, the heirs
or successors and assigns of the party of the second part forever.
AND the party of the firat part covenants that the party of the first part has not done or suffered any-
thing whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with Section 13 o the Lim Law,covenants that the pa
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement
and wiU apply the same first to the payment of the eost of the improvement before using any part of
the total of the same for any other purpose. -
The word 'party" shall be construed as if it read"parties" whenever the sense of this indenture an
requires.
