lawful money of the United States, and other good and valuable eonsiderationpaid
by the party of the second part,does hereby grant and release unto the party of the second part,the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected, situate,
lying and beings at New Suffolk, Town of Southold, County of Suffolk,
and State of New York, bounded and described as follows:
BEGINNING at a point on the southwesterly line of a 33 foot
private road at the southeasterly corner of land of the parties of
the second part, as described in deed Liber 3754, page 63; from
said point of beginning running along said southwesterly line of
said 33 foot private road South 290 52' 4011 East 50.0 feet to a
}' monument and other land, of the party of the first part; running
thence along said other land North 870 55' 00" West 110.0 feet to a
canal; thence along said canal North 290 52' 40" West 50.0 feet to
,. other land of the parties of the second part; running thence along
said land South 870 55' 00" East 110.0 feet to the point or place
of BEGINNING.
TOGETHER with a right of way 33 feet in width from Old Harbor
Road southwesterly and thence southerly to the southeasterly corner
of the premises for access between said premises and Old Harbor
Road.
The parties of the second part, their heirs, executors, admin-
istrators and successors shall have a right of way and free access
to all of the canals in the Harrington H. Tuthill property, known
r, =-aldo as School House Creek Association, and to have the sole use
of 15 feet "the canal in front of and adjacent to the premises
herein c9nveyed to maintain landings and docks; the parties of
the second part, and their grantees or successors in interest,
to leave a right of way for vessels to come and go freely of at
least a 30 foot channel in the middle of the canal.
Said parties of the second part, for themselves, their heirs
or their successors in interest agree to pay a pro rata share with
all other owners, grantees and lessees of the School House Property
of the cost of maintaining at all times 4 feet of water at low
tide in the canals. Said pro rata share to be used on the canal
frontage of the parties of the second part and at the fair market
price per cubic yard for such work, all of which relates to the
30 foot channel and excludes the 15 feet adjacent to owners and
lessees of the canal frontage reserved to owners and lessees.
TOGETHER with an easement to the parties of the second part
for driving and maintaining a well, installing and maintaining
pumping equipment in the pump house on other premises approximately
15 feet southeast of the first right of way above mentioned and
approximately 150 feet southwest of Old Harbor Road, for laying and
maintaining a water main from said pump house to the northeast
corner of the premises herein conveyed, said water main to be at
least 2 feet underground and to run from said pump house to the
first right of way mentioned, and at right angles thereto, and
thence along the first right of way and the second right of way
to the no*thenst corner of the premises.
This is a correction deed to a deed between the parties dated
March 31, 1967 and recorded in Suffolk County Clerk's Office on
April 20, 1967 in Liber 6140, page 404 to set forth a correct
description of the premises.,and rights and privileges in the
canals, and the easements, herein set forth.
