Shays , residing at 32 Wheat Sheaf Lane, Princeton, New Jersey, ` RJ�uc party of the first part, and James Arthur Kenniff, residing at Southold, Suffolk County, New York, and Jonathan P. Rosen, residing at 40 East 69th Street, New York, New York, patty of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable con- sideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being ilwg* at New Suffolk, Town of Southold, County of Suffolk and State of New York, bounded and described as follows : BEGINNING at a point on the easterly side of First Street at the southwest corner of the premises herein described where the division line between said premises and the land now or formerly of the Radel Oyster Company adjoining on the south intersects the said easterly side of First Street; running thence C14North 60 54' 30" East along the easterly side of First Street, 211,02 feet to oo ' the corner formed by the intersection of the easterly side of First Street with I the southerly side of Main Street; thence South 830 45' East along the southerly �.{ side of Main Street 193.50 feet to the southeast corner of said Main Street; thence North 60 15' East along the easterly end of Main Street, 49.50 feet to the northeast corner of Main Street; thence North 830 45' West along the riorlherly side of Main Street, 192 .94 feet to the corner formed by the intersection of a\ the northerly side of Main Street with the easterly side of First Street; thence J1 along the easterly side of First Street, North 60 54' 30" East 272 .45 feet to the land formerly of David H. King; thence South 830 47 ' 30" East along said last mentioned land to Peconic Bay; thence in a general southerly direction d along Peconic Bay to the northerly line of land of Radel Oyster Company; thence along said land of Radel Oyster Company, North 830 05 ' 30" West to the easterly ' side of First Street at the point or place of Beginning. TOGETHER with all the right, title and interest of grantors in and to several grants of land under water directly in front of these premises conveyed. BEING and intended to be the same premises as conveyed by Ruth T. Houston to James Arthur Kenniff and Philip F. Lindner in Deed recorded in the Office of the Clerk of Suffolk County on December 2 , 1960, in Liber 4915 of Conveyances, at page 376, and ALSO BEING and intended to be the same premises as conveyed by Philip F. Lindner to Philip R. Shays in Deed recorded in the Office of the Clerk of Suffolk County on September 13, 1961, in Liber 5047 of Conveyances, at page 409 . TOGETHER with all right, title and interest, if any, of the party of the first part in and to any street and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part oovemm that the party of the first part has not done or suffered any- thing whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a the fund to be applied first for the purpose of paying the cast of the improvement and will apply the same first to the payment of the cost of the improvement before Luing any part of the total of the same for any other purpose The word "party" shall be construed as if it head "parties whenever the sense of this indenture so requires.
