BEGINNING at a concrete monument set on the easterly side of
Grathwohl Road at the southwesterly corner of the premises herein
described adjoining land of Kouros on the south, said monument being
187 . 48 feet as measured along the easterly side of Grathwohl Road from
its intersection with the northerly side of Kouros Road; from said
point of beginning running thence along the easterly side of Grathwohl
Road, North 50 41' 10"West 206. 42 feet to a concrete monument and the'
southerly side of Fanning Road; running thence along the southerly
side of said Fanning Road, South 81° 21 ' 30" East 375.0 feet to a
monument and land of Tyler; running thence along said land of Tyler
South 8" 38' 30"West 200. 0 feet to land of Terhune; running thence
along said land of Terhune and Kouros, North 810 21 ' 30" West 323. 9:>
feet to the monument and place of beginning.
SUBJECT, however, to an easement in favor of Harry H. Tuthill
as contained in an agreement dated July 27 , 1951 and recorded in
Liber 3246 at page 424. Said easement being in the southwest corner
of said premises bounded 10 feet on Grathwohl Road and being 50 feet
in depth along land of Kouros. Said easement being for the installa-
tion of a well, pumping equipment, tank and water main.
BEING AND INTENDED TO BE the same premises conveyed to the
grantor herein by deed dated October 31, 1957, recorded November 6,
1957 in Liber 4387 cp 270.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first pant covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improver nt and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read"parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
