CAPPELLO, residing at 139 Gordon Road, Valley Stream, 0 ' New York, party of the second part, WITNESSETH,that the party of the first part, in consideration.of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the patty,of the second part forever, ALL that certain plot, ppiece or pparcel of land, wit t eeliut?dinjs X'`AUXAF&ements thereon erected, situate, lying and being in the Town oi' Southold,/County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a point on the westerly side of Fifth Street distant 210_.0 feet southerly as measured along the westerly side of Fifth Street from the corner formed by the intersection of the southerly side of Jackson Street with the westerly side of Fifth Street; running thence along they westerly side of Fifth Street, South 6 degrees 44 minutes 00 seconds West 258, 0 feet to the ordinary high water mark of the Gretit Peconic Bay; running thence along the ordinary high water mark of the Great Peconic Bay, North 76 degrees 08 minutes West 98.43 feet to land now or formerly of Quinn; thence along land now or formerly of Quinn the following; North 6 degtees 08 minutes 20 seconds East 244, 50 feet and thence South 84 degrees 00 minutes East 100, 21 feet to the westerly side of Fifth Street at the point or place of BEGINNING, SUBJECT TO a mortgage now a lien on the aforesaid premises held by / Hugh Quinn recorded in the Suffolk County Clerk's Office on 7/26/73, in Liber 6799 mp 245 in the unpaid amount of $25, 000.00, which mortgage debt with interest from July 3, 1973 the grantee hereby assumes and agrees to pay. The grantors are the same persons as the grantees in Deed recorded in Liber 7451 Page 512. TOGETTIER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and'all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first pant covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this in re so requires.
