The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, May 16, 2007:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit #4665 to include approximately 140ft. of additional pre-existing bulkheading a
stairway to the beach and two timber walls, and to repair the existing permitted
bulkhead and stairs, and as depicted on the survey prepared by Staley J. Isaksen, Jr.,
last revised 11/04/97, received on April 17, 2007.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

We are applying for an amendment to permit number 4665, issued to us on
November 26,1996, which references approximately 99 feet ofbulkheading that needed to be
reconstructed in 1996 when we purchased the property. We would like to amend the permit to
also include a reference to approximately 140 feet of additional pre-existing bulkheading and a
stairway to the beach. This additional section ofthe bulkheading, which surrounds the c.I927
beach house structure, was constructed many years prior to our purchase of the property in 1996.
Our intent is to request an amendment to permit 4665 so that it comprises the entire length of
bulkheading on our property as well as the stairs to the beach. We have attached a copy of the
most recent survey of our property, showing the structure and location of the bulkheading in its
entirely, including the stairs to the beach.
At this time, we also are requesting permission to repair storm damage to our
bulkheading. In particular, recent storms have washed away a substantial amount ofthe stone
fill in our bulkheading and the sand fill behind the bulkheading, have caused some structural
damage to the bulkheading itself and have destroyed a set of stairs to the beach. The loss of the
fill and the structural damage have weakened the bulkheading and we are concerned that another
significant storm could cause the bulkheading to fail, causing substantial damage to our property
and that of our neighbors.
Our intent is to restore the bulkheading to the condition approved pursuant to
permit number 4665, referenced above, including restoring portions of the bulkheading that were
not reconstructed at the time we were issued the permit. This work will principally require (1)
the replenishment ofthe clean stone fill and sand, to be trucked in from an upland source, behind
the bulkhead, graded to match the elevation ofthe land immediately adjacent to the bulkhead; (2)
repair or replacement of damaged fascia boards and stringers on the face of the bulkhead; and (3)
restoration of the stairs and related supports, in the location shown on the attached survey. (The
stairs would run down to the beach from the existing platform at the top of the bulkhead and
could be raised using the existing crank and pulley system.)

consideration for the issuance of me Permit does understand and prescribe to the fol-
1. That the said Board of Trustees and the Town of Southold are released from any and
all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Permittee will, at his or her own expense,
defend any and all such suits initiated by third parties, and the said Permittee assllmes full liability
with respect thereto, to the complete ."c1nsion of the Board of Trustees of the Town of Sootbold
2. That this Permit is valid for a period of 24 mos. which is coosideted to be the
estimated time required to complete the work involved, but should circumstances warrant, request
for an extension may be made to the Board at a later date.
3. ll,at this Permit should be retained indefinitely, or as long as the said Permittee wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that auth-
orization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along
the beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the
work shall cause unreasonable obstrllcoon to free navigation, the said Permittee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.
8. That the said Board will be notified by the Permittee Ot the completion of the work auth.

9. That the Permittee will obtain all other permits and consents chat may be required sup-
plemental to this permit which may be subject to revoke upon failure to obtain same.

The following action was taken by the Board of Town Trustees
during its regular meeting held on November 22, 1996, regarding
the above matter:
WHEREAS, DOUGLAS BORISKY applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated October 28,
1996, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on November 22, 1996, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
DOUGLAS BORISKY to replace (within 18") 99+1- l.f. of timber
bulkhead and backfill with 12c.y. of clean sand to be trucked
in from an upland source.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.

it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.
