with the plan prepared by Land Use Ecological Services dated May 19, 2005.

Dear Ms. Cantara:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., May 18, 2005 regarding the above matter:
WHEREAS, Land Use Ecological Services, Inc. on behalf of GRACE KEHLE applied to
the Southold Town Trustees for a permit under the provisions of Chapter 97 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated April 1 ,2005 and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on May 18, 2005, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
South old Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of GRACE KEHLE to
construct a 3'X 95' timber catwalk terminating with stairs down to the water, elevated
2.0' above grade and composed of fiberglass grating, with the condition the remains of
the old dock are removed, and all as depicted on the plan prepared by Land Use
Ecological Services last dated May 19, 2005.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
Fees: $590.00

Dear Ms. Cantara:
Pursuant to IS CFR 930.58, the following data and information is necessary to enable the Department of
State to adequately assess the coastal zone effects of this proposed project:
The proposed project would be undertaken in and adjacent to the State designated Cutchogue Harbor and
Wetlands Significant Coastal Fish and Wildlife Habitat (narrative enclosed). The submitted photographs and
aerial photographs depict an area of shallow water with vegetation. It is not clear from the revised
submission whether the proposal would still be used to moor a sailboat. Please submit information
demonstrating whether the modified proposal is or would be reasonable and necessary, and is or would be
appropriate to the location based upon the proposed uses and the resources present at and near the site.
Please provide information demonstrating whether permission has been obtained from the owners of the
underwater land. The requested information is necessary to assess the consistency of the proposal with the
NYS Coastal Management Program as expressed in the Town of Southold Local Waterfront Revitalization
Program.
The Town of South old Local Waterfront Revitalization Program is requested by copy of this letter to indicate
any preliminary comments or concerns no later than August 18,2005.
Please provide the information requested above as soon as possible. If this necessary information and data is
not provided within thirty days of the date of this letter, the Department of State may close the file regarding
this proposed activity. If the Department closes the file and does not concur with the consistency
certification provided for this proposed activity, the consistency provisions of the federal Coastal Zone
Management Act prohibit federal agency authorization of the activity.

swimming and the mooring of a small sailboat. As such this is considered a water-dependent

The fish and wildlife habitat of Mud Creek (Baldwin's Creek) will not be adversely affected by
the proposed project. The only temporary impact may occur during construction, with increased
turbidity and physical disturbance to the wetland area.

The applicant proposes to build a 127' by 4' timber wooden piling dock, terminating at
the end into and "L" shape 16' by 4'. The dock will have the capacity for one (I) vessel. The
dock would be supported by 6" diameter timber pilings spaced I 0' apart and would be
constructed 3.5' above the existing grade. The dock would extend to a low tide water depth of
1.4'.

The purpose of this form is to provide the Corps of Engineers with basic information

proximate to your project site. Please refer to attached photographs.
4. Provide a copy of any environmental impact statement, or any other
environmental report which was prepared for your project.
5. Provide a thorough discussion of alternatives to your proposal. This discussion
should include, but not necessarily be limited to, the "no action" alternative and
altemative(s) resulting in less disturbance to waters of the United States. For filling
projects in waters of the United States, including wetlands, your alternatives
discussion should demonstrate that there are no practicable alternatives to your
proposed filling and that your project meets with current mitigation policy (i.e.
avoidance, minimization and compensation).

MOORING FACILITIES
Answer the following if your project includes the construction or rehabilitation of
recreational mooring facilities.
1. It is generally recommended that any fixed piers and walk ramps be limited to four
feet in width, and that floats be limited to eight feet in width and rest at least two feet
above the waterway bottom at mean low water. Terminal floats at private, non-
commercial facilities should be limited to 20 feet in length. If you do not believe your
proposal can meet with these recommendations, please provide the reason(s).
This project proposes the construction of a 127' x 4' dock that terminates in an "L"
shape 16' x 4'. The width of this dock is consistent with the reccomendations of this
department.
2. Using your plan view, show to scale the location(s), position(s) and size(s)
(including length, beam and draft) of vessel(s) to be moored at the proposed facility,
including those of transient vessel(s) if known.

3. For commercial mooring sites such as marinas, indicate the capacity of the facility
and indicate on the plan view the location(s) of any proposed fueling andlor sewage
pumpout facilities. If pumpout facilities are not planned, please discuss the rationale

This is for private, recreational use, therefore this does not apply.
4. Indicate on your plan view the distance to adjacent marine structures, if any are
proximate and show the locations and dimensions of such structures.
There are no existing adjacent marine structures on
or near the project site.
5. Discuss the need for wave protection at the proposed facility. Please be advised
that if a permit is issued, you would be required to recognize that the mooring facility
may be subject to wave action from wakes of passing vessels, whose operations
would not be required to be modified. Issuance of a permit would not relieve you of
ensuring the integrity of the authorized structure(s) and the United States would not
be held responsible for damages to the structure(s) and vessel(s) moored thereto
from wakes from passing vessels.
The proposed dock would be located in a smaller area of Mud (Baldwin's) Creek and
would be somewhat protected from wave action due to wake from passing vessels.
Wave protection has been taken into consideration during the design of the proposed
dock.
BULKHEADINGIBANK STABILlZA TIONIFILLlNG ACTIVITIES
Answer the following if your project includes construction of bulkheading (also
retaining walls and seawalls) with backfill, filling of waterslwetlands, or any other
bank stabilization fills such as riprap, revetments, gabions, etc.
1. Indicate the total volume of fill (including backfill behind a structure such as a
bulkhead) as well as the volume of fill to be placed into waters of the United States.
The amount offill in waters of the United States can be determined by calculating the
amount of fiff to be placed below the plane of spring high tide in tidal areas and
below ordinary high water in non-tidal areas.
