Dear Mr. McClure:
The Southold Town Board of Trustees reviewed your letter received on May 18, 2007
and determined the replacement of the existing pool deck and second-story deck to be
out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and
Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

Ladies and Gentlemen:
I intend to replace the existing pool deck and second-story deck at our home at 435
Westview Drive in Mattituck with new materials. We are in the process of submitting
plans for this renovation to the Building Department.
In previous discussions with the Board of Trustees regarding jurisdiction, it was unclear
whether or not this project work was within 100 feet of tidal wetlands. In doing
subsequent research, however, I uncovered documentation that shows definitively that the
decking we intend to replace lies completely outside the 100-footjurisdictional zone.
I have attached the following documents pertaining to my property:
1. Board of South old Town Trustees Permit #5113, dated February 28,2000, for
construction of a dock on the property, issued to Charles Sirey, from whom we
acquired the property on September 8th, 2003.
2. The site plan for the dock construction approved by the New York State
Department of Environmental Conservation, which was submitted to the Board of
Trustees in conjunction with Mr. Sirey's application and which indicates the
relative locations of the deck and wetlands border.
3. The project detail showing a close-up delineation of the wetlands boundary, also
approved by NYS DEC and also submitted previously to the Board of Trustees.
As you can see on the enclosed approved diagrams, the decking is at its nearest point no
less than 125 feet from the wetlands boundary. This being the case, I do not believe that
the reconstruction of the deck requires authorization by the Board of Trustees. If
however, you do not believe this evidence is conclusive, I hereby grant the Board of
Trustees unfettered access to my property, located at 435 Westview Drive in Mattituck,
for the purpose of a site visit to make such a determination.
Separately, I request that the Southold Board of Trustees transfer Wetlands Permit #5113,
described above, from Charles Sirey to me, Eric W. McClure, in keeping with my
acquisition of the property from Mr. Sirey on September 8th, 2003. It would be my
pleasure to submit any additional proof of ownership the Board so requires in order to
effect such transfer.
