TERMS AND CONDITIONS
The Permittee, Raymond Ramondi, 1150 Mason Drive, Cutchogue as part of the consideration
for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of South old are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of South old.
2. That this Permit is valid for a period of24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That iffuture operations of the Town of South old require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion ofthe Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Just,
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, July 19, 2006 regarding the above matter:
WHEREAS, J.M.O. Environmental Consulting as agent for RAYMOND RAMONDI applied to
the Southold Town Trustees for a permit under the provisions of Chapter 275 of the South old
Town Code, the Wetland Ordinance of the Town of Southold, application dated June16, 2006,
and
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
July 19, 2006 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 275 of the South old
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,

WHEREAS, the LWRP coordinator has found the proposed construction to be consistent with
the policies of the LWRP, and,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of RAYMOND RAMONDI to
reconstruct in-place 377' of timber bulkheading, 43' timber groin to be low profile, 4' x 51' fixed
dock, 3'x3' steps, 3'x2' steps, 4'x5' beach access stairs, dredge the existing 51' x 22' slip to -4'
ALW, use the spoil to backfill the reconstructed bulkhead as needed with any remaining spoil to
be trucked to an upland site for disposal, with the conditions of the use of a silt boom/turbidity
screen during construction and dredging, a 15' non turf buffer, close the pipe in the bulkhead,
restore any wetland grasses disturbed, letter of permission from the neighbor to the west, and
all as depicted on the plans prepared by JMO Environmental Consulting amended November
16,2006.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
This is not a determination from any other agency.

CONSERVATION ADVISORY COUNCIL
TOWN OF SOUTHOLD
At the meeting of the Southold Town Conservation Advisory Council held Mon., July 17,
2006, the following recommendation was made:
Moved by Don Wilder, seconded by Jack McGreevy, it was
RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH
CONDITIONS of the Wetland Permit application of RAYMOND R. RAMONDI to
reconstruct in-place 377' of timber bulkheading, 43' timber groin, 4'X 51' fixed dock, 3'X
3' steps, 3'X 2' steps, and 4'X 5' beach access stairs and to dredge the existing 51'X 22'
slip to -4' ALW. The resultant spoil (145 cy. sand) shall be used to backfill the
reconstructed bulkhead as needed and any remaining spoil shall be trucked to an
upland site for disposal.
Located: 1150 Mason Dr., Cutchogue. SCTM#104-7-6
The CAC recommends Approval of the application with the Condition the wetlands on
the seaward side of the bulkhead are restored and a 20' non-turf buffer is installed
landward of the bulkhead. The CAC questions the need for the groin.

Dear Mr. King:
I am presently writing you as a follow up to the Board's meeting of 7/19/06
at which time this application was approved along with a number of
conditions set by the Board. For your review I have enclosed copies of our
plans (sheets 1-4) for the project which have been revised to depict the
requested modifications/conditions. Kindly note that the plans have been
revised to depict a IS' non-turf buffer, that a silt boom shall be temporarily
installed at the mouth of the existing boat slip during construction activities,
that the existing groin shall be reconstructed in a "low profile" fashion, that
the existing drain pipe located in the boat slip shall be closed and that any
disturbed grades of wetlands shall be restored. Sheet 4 of 4 has been added
to depict the reconstruction of the 43' groin in a "low profile' fashion.

The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of
the Town of Southold Town Code and the Local Waterfront Revitalization Program
(L WRP) Policy Standards. Based upon the information provided on the L WRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is generally
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
L WRP provided that:
1. Where water depths permit (Boat slip dred!!:in!!: area) require the installation
of a silt boom/turbidity screen durin!!: construction activities to minimize
turbidity in the water column.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency ofthe proposed action.

making a determination of consistency. *Except minor exemPt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the L WRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the L WRP policy
standards and conditions. If an action cannot be certified as consistent with the L WRP policy
standards and conditions, it shall not be undertaken.

The project consists of the applicant's proposal to reconstruct in place the
following structures: 377' of timber bulkheading, 43' timber groin, 4' x 51'
fixed dock, 3' x 3' steps, 3' x 2' steps, and 4' x 5' beach access stairs and to
dredge the existing boat slip (51' 22') to -4' ALW. The resultant spoil (145
c.y. sand) shall be used to backfill the reconstructed bulkhead as needed and
any remaining spoil shall be trucked to an upland site for disposal.
As part of my review of the Town's LWRP Consistency Form Section C, I
offer the following comments regarding the Local Waterfront Revitalization
Policies and this proposed project:
Policy 1. I do not feel that this policy is applicable to this project because
the project will not result in a negative impact upon the desired
development pattern of the Town of Southold nor shall it result in the loss of
the community and landscape pattern of the Town of South old.
Policy 2. I do not feel that the project as proposed shall have any impacts
upon the preservation and retention of historic resources, or any
archeological resources nor the Coastal Culture of the Long Island Sound.
The reason for this is that the project site has previously been "disturbed"
and developed. The property itself was previously disturbed when the
existing single family dwelling, shed, driveway, dock, groin and
bulkheading were constructed.
Policy 3. I do not feel that this policy is applicable to the project since the
project will not have an impact on any scenic resource of the Town of
Southold.

Policy 4. I feel that the project is consistent with this policy for a number of
reasons. The proposed dock reconstruction and shoreline stabilization
project has been based upon sound engineering practices and designed to
the minimum scale necessary. The project shall have no adverse impacts
upon adjacent properties or to natural coastal processes or natural resources.
The project shall have no impact on any natural protective features nor shall
it have any impacts upon public lands or lands in public trust. Lastly, the
project does not involve the management of a navigational infrastructure
nor are public funds involved with the project.
Policy 5. I feel that the proposed project is consistent with this policy for a
number of reasons. The project does not involve any direct or indirect
discharges that would cause any negative impacts upon water quality
standards. The project, which involves the reconstruction of a timber
bulkhead, groin and dock and dredging will cause a one-time short-term
increase in turbidity during construction activities. There shall be no
increase or decrease in the pH, the dissolved oxygen or nutrients in the
waterway and there should be no increase in noxious odors at the project
site. There shall be no increase in negative health impacts such as
pathogens, chemical contaminants or toxicity nor shall there be any negative
aesthetic factors involved with the project. As previously noted during the
construction activities involved with the project there shall be a short-term
one-time increase in the turbidity of the waterway. This will involve a
short-term discoloration of the waterway until the suspended solids sink to
the bottom. This may be mitigated by the installation of a turbidity curtain
across the mouth of the boat slip while the dredging is taking place. The
project does not involve watershed development or the quantity or quality of
potable water.
Policy 6. I feel that the project is consistent with this policy. The project as
proposed shall have no impact upon the ecological quality in the Town of
Southold. There shall be no negative impacts upon the adjacent West
Harbor by the destruction of habitat or significant impairment to the
tolerance range of any species of fish or wildlife. The project has also been
designed to meet with of the regulatory requirements of the Board of Town
Trustees of the Town of South old, the New York State Department of
Environmental Conservation, the New York State Department of State
Coastal Management Program and the Army Corps of Engineers and to not
have any impact on existing wetlands. The project should have no impact

whatsoever upon any vulnerable fish, wildlife, plant species or rare
ecological communities.
Policy 7. I do not feel that this policy is applicable to this project since the
project does not involve any atmospheric deposition of pollutants.
Policy 8. I believe that the project is consistent with this policy. The project
shall involve the disposal of solid waste, the old bulkheading, dock and
groin, which shall be removed from the project site as part of the project.
There are no hazardous waste or toxic pollutants involved with the project.
Policy 9. I do not feel that this policy is applicable to this project. The
proposed project shall have no impact upon adequate physical public access
to coastal resources, shall not impact any public visual access to any lands
or waters, involve the public interest in and use oflands and waters held in
public trust or to public access of such areas.
Policy 10. I feel that the project is consistent with this policy. The project
shall have no impacts upon any existing water-dependent uses of the site nor
is the project located on Mattituck Creek/Inlet, Mill Creek or within the
Village of Greenport and does not involve water-dependent uses at those
sites.
Policy 11. I feel that the project is consistent with this policy. The project
does not involve aquaculture or the removal of shellfish from uncertified
waters of the Town of Southold nor shall it have a negative impact upon the
long-term maintenance and health ofliving resources.
Policy 12. I do not feel that this policy is applicable to the project because
no agricultural lands are involved.
Policy 13. I do not feel that this policy is applicable to the project since the
project does not involve energy or mineral resources.
