HomeMy WebLinkAboutFerry Landing Repair Bidder: Spearin-Conduit, Joint Venture PROPOSAL TO: Board of Commissioners Fishers Island Ferry District Fishers Island Town of Southold, New York Gentlemen: The undersigned Bidder has carefully examined the form and content of the Contract, has examined the site of the work, and hereby proposes to furnish all necessary plant, labor, materials, equipment and tools required to perform and complete the work in strict accordance with the contract. The undersigned Bidder agrees to submit to all conditions reported, intended, or implied, both particularly and general- ly by the contract at the prices herein stated for: Repair and Improvement of Ferry Landing and Dredging Improvements at Fishers Island N.Y.S. D.O.T. Project No. The undersigned Bidder also agrees as follows : FIRST: If this proposal is accepted, to execute the contract within ten (10) calendar days of date of notice of award of contract, and furnish to the Owner satisfactory surety bonds each in the sum of One Hundred percent (100%) of the amount of the contract awarded as security for the faithful performance of the work, and for the payment of all persons performing labor and furnishing materials in connection with the work. SECOND: To begin work within twenty (20) calendar days of the date of "Notice to Proceed" , and to prosecute said work in such manner as to complete all work within one hundred and twenty (120) calendar days from the date of "Notice to Proceed" . Bidder: Spearin-Conduit, Joint Venture 5% of Bid Amount (Bid'gn THIRD: To/accompany this proposal, is a Bid Guaranty in the amount of:/)$ which is to be forfeited as liquidated damages , if in the event that his proposal is accepted, the undersigned shall fail to execute the contract and furnish satisfactory contract bond under the conditions and within the time specified in the proposal; otherwise said Bid Guaranty is to be returned to the undersigned. FOURTH: To pay the Owner liquidated damages in the sum of Five Hundred Dollars ($500 . 00) for each calendar day of delay in completing the work beyond the specified time of completion, or within the time to which such completion may have been exten- ded in accordance with the Contract Documents. FIFTH: To acknowledge receipt of ADDENDA to the Contract Documents as follows: Addendum No. 1 - Dated 1-19-77 Addendum No. 2 - Dated 1-25-77 Addendum No. 3 - Dated 2 " 9- ]� Addendum No. 4 - Dated SIXTH: Additional Information--When a determination has been made to award the contract to a specific Contractor, such Contractor may be required, prior to award, or after the award, or both to furnish such pertinent information regarding its own employment policies and practices as well as of its proposed Subcontractors as the sponsor may require. SEVENTH: To certify with respect to non-collusive bidding as follows : Pursuant to Section 103a of the General Municipal Law: The refusal of a person, when called before ,a grand jury to testify concerning any transaction or contract had with the Fishers Island Ferry District, to sign a waiver of immunity against subsequent criminal prosecution or to answer any relevant question concerning such transaction or contract. (a) shall disqualify such person, and any firm, partner- ship, or corporation of which he is a member, partner, director or officer from thereafter selling or submitting bids or re- ceiving awards or entering into any contract with the Fishers Island Ferry District for a period of five (:5) years after said refusal and: (b) any contract made with the Fishers :Island Ferry Dis- trict, department or agency thereof by such person and by any Proposal 2 13 Bidder: Speari.nsConduit, Joint Venture firm, partnership or corporation of which he is a member, partner, director or officer may be cancelled or terminated without penalty, except that any monies due and owing for work done or goods delivered prior to such cancellation shall be paid. Pursuant to Section 103d, of the General Municipal Law, by submission of this bid, each bidder and each person signing on behalf of any bidder certifies , and, in the: case of a joint bid, each party thereto certifies as to its own organization, under penalty of purjury, that to the best of knowledge and belief : (1) The prices in this bid have been arrived at in- dependently without collusion, consultation, communication, or agreement, for the purpose of restricting completion, as to any matter re- lating to such prices with any other bidder or with any competitor; (2) Unless otherwise required by law, the prices which have been quoted in this bid have not been knowingly disclosed by the bidder and will not knowingly be disclosed by the bidder prior to opening, directly or indirectly, to any other bidder or to any competitor; and (3) No attempt has been made or will be made by the bidder to induce any other person, partnership or corporation to submit or not to submit a bid for the purpose of restricting completion.
