and deed restriction to the deed of the subject parcel."
With your receipt of this enclosed item, it is my understanding that the permitee has met all of the conditions of
the permit and may now proceed with construction. The inspection schedule, attached to the issued permit,
indicates that once the proposed construction is completed, the Trustees must conduct a compliance inspection. I

DECLARATION OF COVENANTS AND RESTRICTIONS
THIS DECLARATION, made by Indian Rock Realty, LLC c/o Brian J. Brille, 800
Fifth Avenue, Apartment 21F, New York, New York, 10021, hereinafter referred to as the
DECLARANT, as the owner of premises described in Schedule "A" annexed hereto
hereinafter referred to as the PREMISES) desires to restrict the use and enjoyment of said
~REMISES and has for such purposes determined to impose on said PREMISES covenants
and restrictions and does hereby declare that said PREMISES shall be held and shall be
conveyed subject to the following covenants and restrictions:
DECLARANT have made application to the Board of Trustees of the Town
of Southold (hereinafter referred to as the TRUSTEES) for a permit to
construct a 4'x17' wooden stairway with a 4'x6' landing on the face ora 9-
foot tall Sound-front bluff and a clear 4'x140' unsurfaced trail with an
existing wooded area, as depicted on the plans prepared by S.L. Maresca
Associates last dated June 6, 2007.
As a condition of approval by the TRUSTEES of such permit, the Trustees
required the Declarant to file the permits and the conditions set forth herein
as Covenants and Restrictions. A copy of the TRUSTEE's permit is
attached hereto as Schedule B. The terms and conditions of that permit are
incorporated herein as Covenants and Restrictions. Such covenant and
restriction shall serve as a Notice Covenant and the liber and page of this
covenant and restriction shall be stated in the deed of the subject parcel to
subsequent purchasers of the subject property.
All of the covenants and restrictions contained herein shall be construed to
be in addition to and not in derogation or limitation upon any provisions of
local, state, and federal laws, ordinances, and/or regulations in effect at the
time of execution of this agreement, or at the time such laws, ordinances,
and/or regulations may thereafter be revised, amended, or promulgated.
This document is made subject to the provisions of all laws required by law
or by their provisions to be incorporated herein and they are deemed to be
incorporated herein and made a part hereof, as though fully set forth.
The aforementioned Restrictive Covenants shall be enforceable by the
TRUSTEES or the Town of Southold, by injunctive relief or by any other
remedy in equity or at law. The failure of said agencies or the County of
Suffolk to enforce the same shall not be deemed to affect the validity of this
covenant nor to impose any liability whatsoever upon the County of Suffolk
or any officer or employee thereof.
These covenants and restriction shall run with the land and shall be binding
upon the DECLARANT, their successors and assigns, and upon all persons
or entities claiming under them, and may be terminated, revoked or amended
only with the written consent of the TRUSTEES.
If any section, subsection, paragraph, clause, phrase or provision of these
covenants and restrictions shall, by a Court of competent jurisdiction, be
adjudged illegal, unlawful, invalid, or held to be unconstitutional, the same
shall not affect the validity of these covenants as a whole, or any other part
of provision hereof other than the part so adjudged to be illegal, unlawful,
invalid, or unconstitutional.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, June 20, 2007 regarding the above matter:
WHEREAS, Inter-Science Reseamh A~sociates, Inc. on behalf of INDIAN ROCK
REALTY, LLC (BRIAN BRILLE) applied to the Southold Town Trustees for a permit
under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated May 15, 2007, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on June 20, 2007, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered ail the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of INDIAN ROCK
REALTY, LLC (BRIAN BRILLE) to construct a 4'xl 7' wooden stairway with a 4'x6'
landing on the face of a 9' tall sound-front bluff and clear a 4'x140' unsurfaced trail
within an existing wooded area, and as depicted on the plans prepared by S. L.
Maresca Associates last dated June 6, 2007.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a'fee of $50.00 per inspection. (See attached schedule.)

That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be ~l;iject to the inspection and approval of the Board or its
agents, and non-c0mp]iance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unrehsonabie interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high ahd Iow water marks.
That if future operations of the ToWn of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is'required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such:evidence shall be

and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Indian Rock Realty, LLC (Brian Brille), residin~ at 800 Fifth Avenue, Apt. 21F,
New York, New York, as part of the consideration for the issuance of the Permit does
understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any

That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, June 20, 2007 regarding the above matter:
WHEREAS, Inter-Science Research Associates, Inc. on behalf of INDIAN ROCK
REALTY, LLC (BRIAN BRILLE) applied to the Southold Town Trustees for a permit
under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated May 15, 2007, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on June 20, 2007, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of INDIAN ROCK
REALTY, LLC (BRIAN BRILLE) to construct a 4'x17' wooden stairway with a 4'x6'
landing on the face of a 9' tall sound-front bluff and clear a 4'x140' unsurfaced trail
within an existing wooded area, and as depicted on the plans prepared by S. L.
Maresca Associates last dated June 6, 2007.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review
of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is generally
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
LWRP provided that the following Best Management Practices are applied to
further the policies:
1. No CCA is used in the construction of the stairs.
2. A revegetation plan is provided for the bluff following
construction to control erosion.
3. Existing vegetation on the bluff is protected during construction
and the applicant limits the clearing of vegetation to the area
necessary to construct the access stairway.
Pursuant to Chapter 268 the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

Pro[ected Impacts and Proposed Mitigation:
Considering that only hand equipment will be used to (1) construct the proposed stairway and (2)
to clear vegetation for the trail, it is estimated that disturbance can be kept to a minimum.
Considering that the proposed stairway and trails's dimensions are 4'x21' and 4'x140',
respectively, and assuming 1' of extra disturbance beyond the referenced dimensions, a projected
overall initial site disturbance of 990 square feet can be calculated. Following the proposed
cleating and construction, all disturbed areas located beyond the areas occupied by the stairway
and trail (approximately 346 s.f.) will be re-vegetated with native grasses and shrubs.
INTER ClENCE
The stairway and trail will take less than one week to complete - so within a week, the site will be
restored with native plants once construction is initiated.
Since some erosion and siltation could occur downslope during the construction phase of the
stairway, a haybale and silt fence boundary could be installed near the base of the bluff to contain
any sediment/soils that could become dislodged from the bluff during a heavy rainfall. However,
since (1) the proposed construction and site restoration is estimated to begin and end within a
week and (2) the project disturbance will be restricted to a very small area, the applicant will
defer to the Town and/or the State as to the appropriateness of constructing a project limiting
fence.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This

Dear Mr. King:
We (Inter-Science) have been retained by the above referenced property owner to prepare the
permit applications and provide environmental planning advice for the proposed construction of a
bluff stairway and trail, both in the proximity of tidal wetland and the Coastal Erosion Line. In
specific, the proposal can be broken down as follows:
(1) The construction of a 4' x 21' wooden stairway on the face of a 9' tall soundfront bluff; and
(2) The clearing of a 4' x 140' unsurfaced trail within an existing wooded area.
The proposed trail will connect the stairway to the currently cleared upland portion of the site.
The entire stairway and approximately 43 l.f. of the trail are proposed seaward of the Coastal
Erosion Line.
The stairway will be supported by (8) 4" x 4" wooden posts and will be elevated at least 1' off the~
bluff face. A 2.5' tall wooden handrail is proposed on one side of the structure. All disturbed
areas of the bluff will be landscaped with native grasses and shrubs.
All construction will take place using hand equipment. No large machinery is proposed to be
used. Construction of the stairway should take 1-2 days. Clearing of the trail may take 2-3 days.
The location of the proposed beach stairway was selected on the grounds that this specific portion
of the site has the lowest grade change along the parcels bluff, thus minimizing the size of the
stairway and its impacts on the site. The proposed trail to the stairway follows existing pathways
within the woodland, thus reducing the number of trees and vegetation to be cleared.

Considering that only hand equipment will be used, it is estimated that site disturbance can be kept
to a minimum. It is projected that approximately 990 square feet of land ama will be initially
disturbed by the proposed action. Following the proposed clearing and construction, all disturbed
areas located beyond the areas occupied by the stairway and trail (approximately 346 s.f.) will be
re-vegetated with native grasses and shrubs.
