Property Location: 1595 Bayshore Road, Greenport; CTM 53-4.5
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type 11
category of the State's List of Actions, without an adverse effect on the environment if the
project is implemented as planned.
PROPERTY FACTSMESCRIPTION:The applicant's property is a non-conforming 27,181 square
ft.parcel in the R-40 district with 100 feet along the north side of Bayshore Road and 1-5.62 feet
along the high-water line of Pipes Cove, Greenport. The property is improved with a single-
family,one-story frame dwelling and garage,as shown on the May 26,2004 survey prepared by
Peconic Surveyors, P.C.
BASIS OF APPLICATION: Building Department's October 14,2004 Notice of Disapproval,under
Section 100-239.413,stating that all buildings located on lots upon which a bulkhead,concrete
wall,riprap or similar structure exists and which are adjacent to tidal water bodies shall be set
back not less than 75 feet from the bulkhead. The reason stated in the Disapproval is that the
additions with alterations are less than 75 feet from the bulkhead.
FINDINGS OF FACT
The Zoning Board of Appeals held public hearings on this application on January 20,2005,at
which time written and oral evidence were presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning Board
finds the following facts to be true and relevant:
RELIEF REQUESTED: Applicants request an area variance to permit the construction of a
531.6 sq.ft. deck addition. The new deck is proposed 45+-feet from the existing concrete rip
rap along the sandy beach area and is proposed to cover the existing steps and concrete
retaining wall.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted
and personal Inspections,the Board makes the following findings:
1. Grant of the relief will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The proposed 532 sq.ft.deck will extend to
cover the existing steps and the existing concrete retaining wall. Adjacent neighboring
properties both have a deck of similar size and location.

2. The benefit sought by the applicant cannot be achieved by some method,feasible for the
applicants to pursue, other than an area variance. The dwelling is existing, and will extend
over the concrete retaining wall and stop construction existing on the westerly side of the
dwelling.
3. The variance relief granted herein is not substantial because the house and existing
structures predate the zoning ordinance and the deck will not extend beyond the existing stairs
and retaining wall structure.
4. No evidence has been submitted to suggest that a variance in this residential community
will have an adverse impact on the physical or environmental conditions in the neighborhood.
5. Grant of this variance relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a deck addition,while preserving and protecting the character
of the neighborhood and the health,safety and welfare of the community.
BOARD RESOLUTION: In considering all of the above factors and applying the balancing
test under Now York Town Law 267-B,motion was offered by Member Simon, seconded by
Member Dinizio, it was
RESOLVED,to GRANT the variance,as applied for and shown on the 6-17-2004,revised
9-10-2004 site and construction drawings prepared by Grammas Consultants,
Architects,SUBJECT TO THE CONDITION that the deck remain open to the sky.
This action does not authorize or condone any current or future use,setback or other feature of the
subject propertythat mayviolate the Zoning Code,otherthan such uses,setbacks and othorfeatures as
are expressly addressed In this action.

Dear Mr. Koehler:
The Board of Town Trustees took the following action during its regular meeting held on
Thursday, July 21, 2004 regarding the above matter:
WHEREAS, John Koehler on behalf of FRED KOEHLER applied to the Southold Town
Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code,
the Wetland Ordinance of the Town of Southold, application dated June 30, 2004, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on July 21, 2004, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the
application of FRED KOEHLER to construct a deck attached to the existing house as
per plans prepared by J Grammas Consultants last dated June 17, 2004 and survey
prepared by John Metzger last dated June 9, 2004.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification. ,
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

SPECIAL CONDITIONS
1. The seaward edge of the new deck shall not extend beyond the seaward face of the existing concrete retaining
wall.
2. Any debris or excess material from construction of this project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and or
protected buffer areas.
3. All areas of soil disturbance resulting from this project shall be stabilized immediately following project completion
or prior to permit expiration, whichever comes first. The approved methodologies are as follows:
a. Stabilization of the entire disturbed area with appropriate vegetation (grasses, etc.).
4. The storage of construction equipment and materials shall be confined to upland areas landward of the existing
concrete retaining wall.

Dear. Mr. Koehler:
We have recently received a copy of the Joint Application for Permit you filed with die New
York State Department of Environmental Conservation(NYSDEC).
Please be advised we have reviewed the Joint Application, and based solely upon the
information provided, it appears that a Department of the Army permit is not required for your
proposal.
The Department of the Army regulates construction activities in navigable waterways and
discharges of dredged or fill material into waters of the United States, including inland and coastal
wetlands. If your proposal would involve such work, and has not been portrayed as such in your
Joint Application, you should contact this office inunediately so that a project-specific
detennination can be made as to whether a Department of the Army pennit will be required.

INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d.Upon approval of this application,the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e.No building shall be occupied or used in whole or in pan,for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building pertrut shall expire if the work authorized has not'commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing,the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
