I have been in contact with Mr. Stepnoski's daughter. She
is handling the demolition of her father's garage and barn. Her
name is Joan Eickhoff and she resides at RD #2 Box 300 Cream
Ridge, New Jersey 08514, Telephone #(609)758-7005.
She stated by way of phone conversation on April 28, 1989
that she has contracted with a Mr. Howard Wells of Mattituck to
tear down the above mentioned buildings. She said that she gave
him a down payment. Mr. Wells said that he would start as soon
as the ground dries up.
I requested a letter from her stating these facts and she
said she will comply.
At this point in time, I do not feel that a unsafe hearing
is necessary. If there is no response from her in a week or so,
I will set up a date for a hearing.

UNSAFE BUILDING REPORT

RE: SUFFOLK CO. TAX MAP #1000-97-2-23
Dear Mr. Stepnoski:
Upon receiving a number of complaints to the building
department, it is my duty as a building inspector for the Town
of Southold to address the following conditions.
There are three buildings on your premises that must be
either made secure or demolished. They are as follows:-
BARN STRUCTURE:This building is beyond repair in my
estimation. The roof is completely caved in. Not one rafter is
in place. All the debris from the roof is pushing on the
outside walls making for a very dangerous condition. All
structural integrity of this building is gone.
There seems to be no other alternative than to demolish
this building and remove the debris.
GARAGE: This structure is in need of extensive repair if it
is possible to repair it at all. In my estimation, this
building should also be demolished and debris removed. The roof
is completely decayed from the weather. The base of the garage
is rotted as it rests on locust posts and is in contact with the
ground. It poses a dangerous and unsafe condition to the
surrounding residents.
DWELLING: The house is in very much need of repair. To begin
with the chimney through the center of the roof is cracked and
leaning to one side. There are bricks missing to the point"
where there is a hole clear through the chimney. The siding is
completely weathered affording the structure minimal protection
from the elements if any at all. The rear porch is in a present
state of colapse and needs extensive repair or should be

removed. There is an extension off the rear of the house which
in my estimation should also be removed. All the windows are in
very bad condition as they are not painted and missing glazing.
The doors to the house are open to the weather. The cellar way
is completely open to the outside letting rain water into the
basement. All of these openings in the house provide access to
the public and constitute a dangerous and unsafe condition.
There is also a well at the rear of the house that is about
three feet in diameter and is completely open. There is also
debris around the outside of the house.
In my estimation the house could be restored with extensive
repairs. In the meantime it should be secured as to eliminate a
dangerous and unsafe condition. The well at the rear of the
house should also be secured.
All of the observations were made from an exterior
inspection. An interior inspection of the house would, I am
sure, reveal other problems that would have to be corrected.
Some of these problems being in the plumbing and electrical
systems.

THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED BY THE
SOUTHOLD TOWN BOARD AT A REGULAR MEETING HELD ON APRIL 25, 1989:
WHEREAS, the Building I nspector of the Town of Southold has made a formal inspection
of the premises owned by Julia Sepenoski and referred to as: Suffolk County T ax Map
designation: District 1000, Section 68, Block 4, Lot 18, and also known as CR 48,
Peconic, New York, and thereafter prepared a written report thereon and filed the
same in his office; and
WHEREAS, it was determined by the Building I nspector that the building or structure
on said premises is dangerous or unsafe to the public; and
,WHEREAS, the Building I nspector promptly thereafter served a notice on the owner,
their agent, or other persons having an interest in said property, pursuant to the
provisions of Chapter 90 of the Southold Town Code; and
WHEREAS, said notice required that the owner of said premises either make the build-
ing on the premises safe and secure, or remove same, and secure the perimeter of the
property to prevent unauthorized persons from entering the property, said work to
commence within ten (10) days from the date of service of the notice and shall be com-
pleted within thirty (30) days thereafter; and
WHEREAS, the owners of said premises has neglected or refused to comply with the
provisions of said notice within the time specified therein; and
WHEREAS, a public hearing on said matter was held by this Board on the 11th day
of April, 1989;
NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED AS FOLLOWS:
1. That based upon the written report prepared by the Building I nspector and
filed in his office and upon the evidence given by the Building I nspector at the hearing
held on April 11, 1989, this Board does hereby determine that the buildings or structures
located on said premises are unsafe or dangerous to the public.
2. That this Board does hereby determine and order that the owners of the
buildings or structures on said premises shall erect a six (6) foot high chain link fence
around the immediate area of the buildings, acceptable and approved by the Building
Inspector, and the owners of the buildings or structures on said premises shall make
safe, to the approval of the Building Inspector, or remove the buildings or structures
on said premises on or before the 31st day of May, 1989.
3. I n' the event that the owners shall neglect or refuse to fence and secure or
take down and remove the structures from said premises within the time specified in
the preceeding paragraph, then and in that event the Supervisor be and he hereby
is authorized and directed to procure estimates for the removal of the buildings or
structures on said premises and submit the same to this Board for its consideration
as soon thereafter as possible.

4. That thereafter this Board shall, based upon such estimate, provide for
the letting of a contract for the taking down and removal of the buildings or structures
on said premises.
5. That the cost and expenses of the taking down and removal of the buildings
or structures on said premises shall be collected by the Town of Southold in the manner
provided for in Section 90- 9 of the Code of the Town of Southold.
6. It' is further ordered that a certified copy of this resolution be sent by the
Town Clerk to the owner of said premises by registered mail, return receipt requested,
within three days of the date hereof.

SUPERVISOR MURPHY: This is hearing on a unsafe building, and I'd like to
ask our Town Council Rob Berntsson to take over.
ASSISTANT TOWN ATTORNEY BERNTSSON: Thank you, Frank. I would note
for the record, that I have called out the name Julia Sepenoski several times,
and there has been no response, so it is my understanding that she is not present
at this time. At this time, we're going to have an unsafe building hearing, pursuant
to Chapter 90 of the Southold Town Code. We will have one witness in this hearing.
It will be Gary Fish, and at this time I'd ask him to be sworn in.
SUPERVISOR MURPHY: Gary, would you raise your right hand. The testimony
that you're about to give is the whole truth and nothing else but the truth, so
help you God.?
GARY FISH: Yes, it is.
SUPERVISOR MURPHY: Thank you.
ASSISTANT TOWN ATTORNEY BERNTSSON: Would you state your name and address
for us, please.

Q And who are you employed by?
A Town of Southold Building Department.
Q And what is your job title?
A Building Inspector.
Q And how long have you been so employed?
A A little over two years.
Q It is one of your duties to inspect buildings for the Town of Southold?

A Yes, it is.
Q And it's another of your duties to inspect unsafe buildings for unsafe con-
ditions?
A Yes.
Q As Building Inspector, did you have an opportunity to inspect property
owned by Julia Sepenoski?
A Yes, I did.
Q And where is that property located?
A It's on North Road, L18, in Peconic.
Q Is that property designated as tax map 1000-68-L1-18?
A Yes, it is.
Q And that's in the Town of Southold, Suffolk County, New York? Is that
correct?
A That's correct.
Q When did you first inspect that property?
A I looked at that property on February 8, 1989.
Q And what was your reason for the inspection?
A An unsafe building complaint.
Q You stated that you had complaints of an unsafe condition?
A That is correct.
Q Can you give us the rough dimensions of the property?
A I believe it's a 39 acre piece.
Q And that's on the north side of the North Road?
A On the north side of L18, about 1 III mile east of Mill Road.
Q And what structures are located on that property?
A There's a one family dwelling that is very--this is the unsafe building, and
a number of, probably six outbuildings.
Q Okay, just so I understand and clarify for the rerord the purpose of this
hearing is for the one family dwelling. Is that correct?
A That's correct.

Q Can you give us the size of that building, the number of stories, and the
type of construction of that building?
A It's a two story building, approKimately 28 by 40, with an extension on it.
It's a wood frame construction with a stone foundation.
Q After you inspected that building on February 8th, what did you determine?
A That it was unsafe, and it should be demolished.
Q After you inspected the property, did you have occassion to determine who
the owner of the property was?
A Yes, I did, through the property card.
Q And who was the owner?
A Julia Sepenoski.
Q I've handed you a document. Can you tell us what that is?
A It is a property card in the Town of Southold.
Q And is that a true and accurate copy of the document that you checked in
the Assessor's Office?
A Yes, it is.
ASSISTANT TOWN ATTORNEY BERNTSSON: At this time, I'd like to offer that
as Exhibit 1.

one sheet, copy on both sides.)
ASSISTANT TOWN ATTORNEY BERNTSSON: At this time, I'd like to offer as
Exhibit 2, a copy from the Surrogate's Court of the probate of the will, indicating
that the property passed from John B. Sepenoski. I'll make that part of the record
as well.

Q As a result of your inspection, did you make a report?
A Yes, I did.
Q And did you communicate with the owner, Julia Sepenoski, of the contents
of that report?
A Yes, I did. I sent by registered mail, a copy of it, and I also posted the
building.
Q I've handed you another set of documents. Can you tell us what they are?
A
Yes,
they are notices that I sent to Julia Sepenoski.
Q It was prepared and signed by yourself?
A Yes, it was.

A Yes, and she signed it.
Q And you received the return receipt?
A Yes.
Q And that is attached as well?

A Yes, it is. It's J. P. Sepenoski.

A Yes, I did.
Q Can you tell us how you did that?
A I took the notice and I stapled it right on to the front of the building.
Q Okay, and was that in a plastic bag?
A Yes, it was.
Q During you inspection, did you take any pictures of the premises?
A I did. Yes.
Q I'm handing you a set of six photographs, and ask you to look at them. Are
those the photographs you, yourself, took~
A Yes. All six of them.
Q Have you indicated the date they were taken?
A Yes. They were taken February 8, 1989.

building at the time that you saw it?

Q And, did you thereafter, take any further pictures?

Q On what date was that?
A It's on there. April 10, 1989.
Q And those pictures are basically the same, of the same structure that's the
subject of this hearing?
A That's right.
Q Do those pictures fairly and accurately represent the condition of the building?
A Yes, they do.
Q Have there been any major changes in the condition of the building from the
time you viewed it on February 8th, until the time you returned yesterday to
take further pictures?
A Maybe, just a little more deterioration. That's about it.
ASSISTANT TOWN ATTORNEY BERNTSSON: At this time, I offer Exhibit 5,

Q So that latest group of photographs fairly and accurately represent the con-
dition of the building as of tOday?
A That's right.
Q In your inspections of the building, how and why did you determine that the
structure was unsafe? Please give us a detailed analysis.
A What appears to be a building, is actually a facade of a building, like a Holly-
wood prop. If you go around the rear of the building, the rear wall is completely
collaP.sed into the building, and which caused65% of the roof to collapse into the
building. The second floor joist and main girder is collapsing to the first floor,
and the first floor is caving into the cellar, and the foundation has many cracks
in it, and there is no way to rebuild on that foundation.
Q In your opinion, is the structure unsafe and beyond repair?
A Oh, yes. Definately.
Q In your notice dated February 23, 1989, which has previously been admitted
into evidence, what did you order to be done?
A For the building to be demolished, and the debris carted away.
Q After you sent the notice, did you receive any correspondence from Julia
Sepenoski?

A Yes, I did. It came in two forms. I got a letter from Mrs. Sepenoski. I,
also, spoke with her son on the phone.
Q Regarding the letter. I'm showing you a document, and asking you, if you
recognize than
A Yes, this is the letter.
Q That's the letter you had received?
A That's correct.
ASSISTANT TOWN ATTORNEY BERNTSSON: At this time, I'd like to offer as
Exhibit No.6, the letter received from Julia Sepenoski. Here's the original letter.
(Town's Exhibit No.6, Letter dated March 30, 1989, and stamped received in the
Building Department on April 3, 1988, from Julia Sepenoski.)
Q And the basic contents of that letter, that she agrees that the building is
structurally unsafe, however she would request more time to demolish it.
A That's true.
Q At any time, did anyone come in to the Building Department to request a
demolition permit?
A Yes, they have gotten a demolition permit.
Q Do you know who it was who appeared in the Building Department?
A I wasn't there. I believe it was her son.
Q I'll show you one last document, and ask you to look at that.
A Yes, this is a demo permit.
ASSISTANT TOWN ATTORNEY BERNTSSON: At this time, I'd like to introduce
Number 7, I believe, the demolition permit issued by the Building Department.

Q In your opinion, Gary, are the structures unsafe and dangerous?
A Definately unsafe.
Q And they are beyond repair?
A Definately.
Q Is there anything else you'd like to add at this time?
A I don't think so.
Q At this time, I have no further questions. If any member of the Town Board
would like to ask, I myself or Mr. Fisher, a question?

SUPERVISOR MURPHY: Gary, I noticed a wire up on it. I assume the electrical
has been cut off.
GARY FISH: It seems to have been cut off.
SUPERVISOR MURPHY:
I would check on that to make sure.
GARY FISH: I will.
COUNCILWOMAN COCHRAN: On a demolition permit, is there a time frame, so
if you got a demolition permit you could just sit with it for eternity!
GARY FISH: That's the reason I thought we should go through with this, because
she doesn't have to do anything for a year, so the danger is there for a year,
so I think that a time limit should be set.
COUNCILWOMAN COCHRAN: Right. That was my way of thinking. Thank you.
SUPERVISOR MURPHY: Any other Town Board member have any comment?
JUSTICE EDWARDS: From the looks of it here, Frank, the electrical service
has been removed.
SUPERVISOR MURPHY: It has? Okay.
ASSIST ANT TOWN ATTORNEY BERNTSSON: If there are no further comments

D. The above work shall commence within ten (10) days from the
date of service of this notice and shall be completed within
thirty (30) days thereafter.
E. In the event you fail to comply with the above, a hearing
will be held before the Southold Town Board concerning same
at10:00 o'clock A.M. on April 11, 1989 ,at Southold Town
Hall, 53095 Main Road, Southold, New York 11971.
F. In the event that the Southold Town Board after the hearing
herein shall determine that the building or structure is un-
safe or dangerous to the public, the Town Board may order the
building or structure to be repaired and secured or taken
down and removed.

of the neglect or refusal of the owner to repair or remove
