The owners of the property have complied with the Notice dated April 12, 1985, so there is no need to hold the hearing scheduled for June 4, 1985. I am closing my file on this matter. The last Assessment Roll of the Town of Southold shows that you are the owner of the following described premises: ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Cutchogue, in the Town of Southold, County of Suffolk and State of New York, and being bounded and described as follows: BEGINNING at a monument on the westerly side of Main Road (New York State Route 25) where same is intersected by the southeasterly corner of land now or formerly of Stanley Rysko; running thence along the westerly side of Main Road the following two (2) courses and distances: (1) South 680 10' 00" West, 246.13 feet to a monument; (2) South 610 54' 30" West, 203.23 feet to a monument; running thence along land now or formerly of Howard Robinson Estate, the following four (4) courses and dis- tances: (1) North 430 28' 50" West 145.00 feet to a monu- ment; (2) South 560 02' 10" West, 263.54 to a monument; (3) North 430 28' 50" West, 61.27 feet to a monument; (4) South 460 27' 00" West, 103 feet to a monument and land now or formerly of Zigmund and Lucille Rysko; thence North 430 33' 00" west, along the last mentioned land 543.98 feet to a monument and land now or formerly of Cox Lane Associates; thence North 430 47' 40" West, along the last mentioned land, 638.53 feet to a monument and land now or formerly of Leander B. The above described premises are the same premises described in a deed recorded in the Suffolk County Clerk's Office in Liber 8983 page 534. Also referred to as: Suffolk County Tax Map Designation District 1000, Section 097.00, Block 01.00, Lots 011.004. and 011.004. B. The two story barn on your premises is structurally unsafe and dangerous and as such constitutes a hazard to safety by reason of inadequate maintenance, dilapida- tion, obsolescence, and abandonment. This structure is beyond repair and should be demolished and removed from the premises. In particular the front portion of the barn has collapsed, the gable ends are ready to collapse, the sills are beyond repair, there are no doors on the barn exposing the interior portions of the barn to the weather and dampness. C. You are hereby ordered to demolish and remove the remains of this structure. D. The above work shall commence within ten (10) days from the date of service of this notice and shall be completed within thirty (30) days thereafter. Please be advised that before commencing any demolition work, you will have to obtain a permit for this purpose. E. In the event you fail to comply with the above, a hearing will be held before the Southold Town Board concerning same at 9:30 A.M. prevailing time on June 4, 1985. F. If the Southold Town Board after the aforementioned hearing shall determine that the remains of the structure is unsafe or dangerous to the public, the Southold Town Board may order the remains of the structure taken down and removed. G. In the event that the remains of the structure shall be determined by the Southold Town Board to be unsafe or dangerous and in the event of your neglect or refusal to remove or correct same within the time provided, the Southold Town Board may remove such structure by whatever means it deems appropriate and assess all costs and ex- penses incurred by the Town of Southold in connection with the proceedings to remove and secure same, including the cost of actually removing the structure from the premises, against the land on which the said structure is located. a~q/( ?/~ CurtJ.s W. On the 16th day of April, 1985, deponent served a copy of Notice Pursuant to Chapter 90 of the Code of the Town of Southold (The Unsafe Building and Collapsed Structure Law of the Town of Southold) upon Harold Kirkby Ressler, 459 West 21st Street, ,New York, New York and Richard Stockton Ressler, 936 R. Central I I Avenue, Framingham, Massachusetts those being the addresses designated by said people for that purpose, by depositing a true copy of same enclosed in a postpaid properly addressed wrapper in an official depository under the exclusive care and custody of the United States Postal Service at Southold, New York.
