Gentlemen: I just reinspected the premises on the Main Road, Peconic, N.Y. , which is the subject of the above cap- tioned matter. I found both cellar doors removed or blown away, also one sheet of plywood gone from the 2nd story rear, several sheets on front ready to blow away. The last Assessment Roll of the Town of Southold shows that you are the owner of the following described premises: ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at peconic, in the Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a point on the Northerly side of the Main Road, at the southwesterly corner of the premises, being the southwesterly corner of land now or formerly of Irving and George Newman; thence North 360 34' 10" West along the last mentioned land 1659.10 feet; thence South 470 19' 50" West, still along the last mentioned land 527.21 feet; thence North 380 46' West still along the last mentioned land 35.65 feet to land now or formerly of the Buckingham Estate; thence North 400 08' 30" West along the last mentioned land 886.47 to land of the Long Island Railroad Company; thence North 440 53' 10" East along the last mentioned land, 1207.62 feet to land now or formerly of Seymour Tobin; thence South 390 13' 30" East along the last mentioned land, 2366.94 feet to land now or formerly of A. The one-family dwelling, located on your premises is struc- turally unsafe and dangerous and as such, constitutes a hazard to safety by reason of inadequate maintenance, dilapi- dation, and abandonment. In particular the rear or north side of the building is open, exposing the interior to the elements. Additionally, doors and windows have been removed. Anyone could gain access to this old home and such person faces the risk of injury due to holes in the main floor. The roof of the front porch is supported by te~porary un- secured supports. Further, you have not adequately fenced and secured the remains of this structure and have left same exposed so that small children can be attracted thereto and enter upon the property at will, which is dangerous to their health and safety. C. You are hereby ordered to demolish and remove the remains of this structure or immediately board it up in order to prevent any further deterioration, and properly fence and secure the perimeter of the property to prevent unauthorized people from entering upon the property. After this is accomplished if you choose to rebuild and refurbish these structures, you will have to obtain a Building Permit from the Southold Town Build- ing Department. D. The above work shall commence within ten (10) days from the date of service of this notice and shall be completed within thirty (30) days thereafter. E. In the event you fail to comply with the above, a hearing will be held before the South old Town Board concerning same at 9:30 A.M. on May 21 1985. F. If the Southold Town Board, after the aforementioned hearing, shall determine that the remains of the structures are unsafe or dangerous to the public, the Southold Town Board may order the remains of the structures taken down and removed. G. In the event the remains of the structures shall be determined by the Southold Town Board to be unsafe or dangerous and, in the event of your neglect or refusal to remove or correct same within the time provided, the Southold Town Board may remove such structures by whatever means it deems appropriate and assess all costs and expenses incurred by the Town of Southold in connection with the proceedings to remove and secure same, including the cost of actually removing the structures from the premises, against the land on which the said structures are located. Terry SUPERVISOR MURPHY: I'd like to open up this public hearing on an unsafe building pursuant to Chapter 90 of the Code of the Town of Southold concerning Adelaide Barr, 228 Lindbergh Street, Massapequa Park. At this time I'd like to ask Curt (Horton--Building Inspector), do you want to speak?--or Frank, okay. FRANK A. ISLER, ESQ.: Good morning. Mr. Supervisor, members of the Board, my name is Frank Isler. I'm a partner with Smith, Finkelstein, Lundberg, Crimmins, & Yakaboski. We're the attorneys handling this matter on your behalf. We have been told that an inspection was made this morning by the Building Department, Mr. Horton, which indicates that there appears to be compliance with the Notice pursuant to Chapter 90. We ask that the Board adjourn this matter to its next regular meeting so that we can be assured that the work that has been done has been done properly and securely and we won't really know that until a little time has passed. So we ask at this time that the hearing be adjourned to your next regular meeting. SUPERVISOR MURPHY: Recessed. MR. ISLER: Yes, recessed. SUPERVISOR MURPHY: Curt, do you have any problems? CURTIS W.
