THIS INDENTURE made in duplicate the // K, day of July,
1956, between the TOWN CF SOUTHOLD, in the County of Suffolk and
State of New York, by a majority of its duly elected Trustees, and
in pursuance of Chapter 615 of the Laws of New York passed in 1093
and in pursuance of a written resolution adopted by a majority of
the Board of Trustees of said Town of Southold at a meeting hold
pursuant to notice duly given to all members thereof on the .
day of 1956, party of the first part, and
John W. Duryea , as Executor of the ESTATE OF P. HARVEY DURYEE
of Mattituck, Suffolk County, Now York, party of the second part,
WITNESSETH, that the party of the first part in consideration of tie

paid before the delivery hereof doth hereby grant, bargain, sell
and release unto the said party of the second part, his successors
and assigns f crever, ALL that piece or parcel of land situate in
the Town of Southold, County of Suffolk, State of New York, bounds
and described as follows:
BEGINNING at a point on the northerly shore of Mattituck
Crook where the high water line is intersected by the division lin
between the lands of P. Harvey Duryea Estate, reputed owner on tho
west, and the lands of Vivian D. Gildersleeve, reputed owner on
the east; running thence southeasterly along the extension of the
aforementioned division line 93A feet to a point 110.00 foot dis-
tant northerly, measured at right angles from station 49+26+ of the
hereinafter described survey line for Middle Road Extension, C.R.
27A; thence southwesterly along an aro deflecting to tho right and
having a radius of 1799.66 feet, an are distance of 80= foot to a
point on the division line (extended southeasterly) botweon the
lands of P. Harvey Duryea Estate, reputed owner on the east, and
the lands of Wilbur A. Kaiser and wife, reputed owners on the west

the last mentioned point being 110.00 foot distant northerly when
measured at right angles from the said survey line; thence north-
westerly along the last mentioned division line 62= feet to the
above mentioned high water line of the north shore of Mattituck
Creek; thence northeasterly along the said high water line 73' fen
to the point of beginning; containing within the above described
bounds 0.130 acres more or less.
The above mentioned survey line is a portion of the survey
line for Middle Road Extension, C.R. 27A9 as shown on a map on file
in the office of the Superintendent of Highways of Suffolk County.
The Town of Southold reserves for the County of Suffolk, it
legal representatives, together with the Contractor, his workmen axd
employees, the right, license and privilege to enter upon the pre-
mises described herein until January 1, 1957 for the purpose of
constructing a hydraulic fill without becoming or being hold liable

z>. for trespass or for any damages whatsoever; otherwise this con-

veyanee shall be null and void.
TO HAVE AND TO HOLD the above mentioned and described pre-
mises with the appurtenances unto the said party of the second part,
his successors and "Signs forever.
a EXCEPTING AND RESERVING to the said Town of Southold, the
full and free right, liberty and privilege of entering upon and
using all or any part of the above described premises in as lawful
a manner as said Town might have done had this conveyance not been
given, until the sameshall have been actually appropriated and
..applied to the purpose of the beneficial enjoyment of the Baso by
