The information you seek is contained in the Planning Board and Town Building Department records, however, in an effort to save you time, I s~it the following information. The subject property presently contains 74.53 acres zoned "A" Residential and Agricultural District and pursuant to recent Local Law No. 7 adopted by the Town Board, the density in this district is 80,00.0 square feet per lot 1 therefore, there is a possible yield of 40 single family units. The portions of the property presently zoned 'Ma Light Multi- ple Residence District contain 57.55 acres including the 19.27 acres in the scenic easement. Since public water and public sewer are going to be provided by the Village of Greenport, Section 100-116 of the Zoning Code is applicable. This section provides that each dwelling unit in a multiple residence district have 6,500 square feet, thereby allowing a yield of 385 individual multiple residence units in this district. Therefore, the portions of the property which are Subject to the zone change application containing the "A" Residential and Agricultural District and "M" Light Multiple Residence District have a possible yield of 425 living units. Such request is made for the following reasons: INTRODUCTION Your petitioner, Brecknock Associates, hereinafter called "Schad", has been the owner of the property known as "Brecknock Hall" on the northerly side of North Road (State Route 25), near Greenport, Town of Southold, Suffolk County, New York, since April 10, 1969. For the last ten years your petitioner Schad has sought to develop this property in a manner which would preserve the natural beauty and character of the land and still provide an attractive place for people interested in leisure and recreation to live, as well as not being bothered with the problems of property upkeep and maintenance. To achieve this goal, the condominium form of ownership for the multiple dwelling units was chosen as being the most desirable. The main problem was to find a builder/developer who could accomplish the design and construction, and who had the financial ability, sen- sitivity and experience required to complete a project of this nature. About a year and a half ago, petitioner Schad was introduced to peti- tioner Leo Wolowitz, hereinafter called "Wolowitz". He was very much interested in building the multiple dwelling units and has the necessary expertise, financial backing, and experience to build a development of this nature. Wolowitz agreed to undertake the project providing he could buy the land outright, including the business district, rearrange the existing zoning and scenic easement on the property. After several preliminary drafts of plans and layouts, it became apparent the land zoned "A" Residential as well as the multiple zoned property would have to be utilized to build a worthwhile development. The existing zoning on the property allows it to be developed on an "as is" basis in an economical fashion, but would result in congestion of the units and provide for an inferior use of the property. Further, to build the multiple living units in this fashion would not be in keeping with what your petitioner Schad desires for the property. Although prac- tical from an economical point of view, from an aesthetic and environ- mental viewpoint there was not enough actual land area being devoted to the multiple residential units, in order to develop the property and still preserve the natural terrain features. Therefore, a master plan had to be projected considering the use of the entire property, both residential and multiple use districts; taking into consideration the topographical features. The result is the Preliminary Master Plan which is attached hereto as Exhibit 2. From this Master Plan the Map of Proposed Zoning Plan (Exhibit 1) evolved. THE PROPERTY The parcel of land on which the multiple units would be erected is bounded on the north by Long Island Sound, on the east by land of Floyd King which is currently used as an IS-hole golf course, and land of Abadiotakis which is currently vacant, on the south by North Road (State Route 25), land of Schofield and McIntosh which contains a residence, and other business property of your petitioner Schad con- taining the two-story stone mansion known as "Brecknock Hall", a large barn, a residence and some outbuildings; and on the west is land owned by Jem Realty Corp., which is farm property (your petitioners understand the Jem Realty Corp. property is also being proposed for some type of multiple use). The petitioner Schad's property which is proposed to be rezoned in order for the plan to be built properly, is an interior parcel con- taining 74.53 acres currently zoned "A" Residential and Agricultural District which is bounded on the north by Long Island Sound and on the east by other land of your petitioner Schad which is zoned "M" Light Multiple Residence District, on the south by land of Schofield and McIntosh and other business zoned property of your petitioner Schad and on the west by Jem Realty Corp. -2- " . . " EXISTING ZONING The property upon which the multiple dwelling units would be located consists of 132.08 acres which are zoned as follows: 74.53 acres zoned "A" Residential and Agricultural District, and 57.55 acres are zoned "M" Light Multiple Residence District. Of these 57.55 acres, 19.27 are burdened by a Scenic Easement with the Town of Southold in which no building can take place. Even considering the current amendments to the Southold Town Zoning Ordinance concerning "A" Residential and Ag,ricultural Districts, the present dwelling unit density for the above-described parcel of land would be 425 individual dwelling units. However, the general orientation of the current multiple zoning in a northerly-southerly direction and the existing "A" Residential zoned property in an easterly-westerly direction, would not be in keeping with the development goals of your petitioner Schad. It became apparent to your petitioner Wolowitz, by doing some extensive land planning engineering, and taking into consideration the existing topography, vegetation (Exhibit 3), existing soil types (Exhibit 4), and the existing slopes (Exhibit 5), it was superior to locate the dwelling units in an east to west orientation, taking advantage of the natural terrain features of the Sound bluffs, the existing ponds, and topography of the property. The final result was the Preliminary Master Plan (Exhibit 2). THE PLAN In an effort to preserve the existing terrain features and to provide a centrally located clubhouse, pool and tennis courts, a master plan was developed to locate the dwelling units to take advan- tage of the property's unique features. This required the use of the residentially zoned property and the relocation of the scenic ease- ment. By utilizing this method, the density was reduced to 350 units and the size of the scenic easement was increased from 19.27 acres to 37.92 acres. See Preliminary Master Plan (Exhibit 2) for relocation of scenic easement, road layout and location of units. The dwelling unit density for the project will be 2.65 per acre. Due to the size and cost of the development, unit construction is proposed to take place in three sections which would take several years to complete. Each section would have its own architectural design to blend in with the property. The common areas would be owned by a homeowners association, and would include the scenic easement areas, the beach, the buffer zone separating the property from the golf course, the existing ponds, clubhouse, pool, tennis and paddle courts, and equestrian center. Negotiations are under way with the Village of Greenport to pro- vide water and sewage service to the project. As to water supply, this appears to be feasible as there is an existing water main on North Road (State Route 2~to service the property. In addition, the Village of Greenport is desirous of providing a connection of the existing Village sewer main located at Bridge Street and Atlantic Avenue in the Village with your petitioners' property. It has been represented that the Greenport Sewage Treatment Plant is adequate to handle any sewage from this area. -3- .. . . " . . . PROPOSED ZONING With the encouragement of the Southold Town Planning Board to reduce and restrict the density to 350 units for the entire parcel, and relocate the units in a fashion that would provide for more space, a rezoning request became mandatory under the existing ordinances and regulations of the Town of Southold. To insure the density would be restricted and open space would be preserved, your petitioner Schad is attaching as part of this application a Proposed Amended Grant of Scenic Easement (Exhibit 6) and Proposed Declaration of Covenants and Restrictions to be placed upon the property (Exhibit 7) if the request to construct the units on this property is granted. There are more than 20 dwelling units so more than one access will have to be provided. The street circulation is poorly designed. It lacks loop type circulation. There are no drainage facilities. There is an excessive overall block length. There are no east side of the property connections. There are no elevations on the bUildings to d~ewine the separation between the buildings. To comply it lacks the 100 foot setback from Long Island Sound. Mr. Raynor feels the entire project should be reconsidered. Where it is so badly designed, Mr. Raynor feels the Board should go back and look at the total planned concept development. As you can see from reading the Scenic Easement, in paragraphs 2(b) and 3(b) the grantor and his successors clearly are given the right to remove trees for the purpose of constructing roadways for lateral access to and from the residential and multiple residence districts. However, the Declaration of Protective Cove- nants and Restrictions covering the landscaped buffer zones does not clearly spell out the right of the declarant to remove trees and topsoil for the purpose of constructing a roadway across the landscaped buffer zones even though the declarant reserves the right in paragraph 6 to dedicate any such streets and roads to the Town of Southold for highway and drainage purposes. In order to have a suitable site plan prepared for the entire property, I find that this point needs clarification. Therefore, if the present posture of the surrounding property in this neighborhood remains the same, will the Southold Town Planning Board, upon the submission of a site plan in accordance with the applicable ordinances and one that is acceptable to the Planning Board, allow the developer to remove the necessary topsoil and trees in order to con- struct a 50 foot wide road in accordance with the existing Town specifications at approximately a mid-point over Land- scaped Buffer Zones II and III for the purpose of pedestrian and vehicular traffic from the North Road (State Route 25) to the Multiple Residence District and the Business and Resi- dential Districts respectively? The Chairman suggested that information be sent to the newspapers to inform the public and brief them on the material. The proposed density will be 7 units per acre, there will be 29 apartment buildings, containing a total of 350 units. There is still some discretion on how the 150 ft. strip off the road should be zoned. The Board suggested that a scenic easement be placed on it. May 1, 1973 Southold Town Planning Board I , 1 . \ \ Mr. Gus Schad, Richard Lark, Esq., and Mr. Howard Young appeared betore the Board in regard to the site plan for Brecknok Hall at Greenport. This plan is for the parcel zoned M-l for conaom~n~ums. The condominiums' are one and two bedroom units and the buildings are combined one and two stories. Mr. Schad said they have problem with the distance between buildings. He submitted a layout of the buildings. Mr. Schad also said the County Department of Environmental Control has teld him the sewage treatment plant must be built and in operation after the first 50 dwelling units are built. The first 50 units must have dry sewage lines. Mr. Lark said the prospectus on the condominiums is filed with the Attorney General. Mr. Schad said the sewage treatment plant will be enclosed and will be in the scenic easement area. Mr. Schad also presented drawings of the style of buildings he intends to build. He said they have four units in center with upstairs and downstairs and two units in each end of the building. The Board told Mr. Schad he will have to go to the Board of Appeals on any variance in distance between buildings. Mr. Schad said they would ask for 25 feet between some of the buildings as a minimum distance. 56 buildings are shown on the layout. The Board told Mr. Schad to figure the average height of the buildings and have all the buildings he can with the required distance and then go to the Board of Appeals.. The Board also told Mr. Schad that all buildings along the Sound must be set back 100 feet. Mr. Schad asked about the proposed east-west road. He had planned having a private entrance to the property and they would be private roads. The Board told Mr. Schad the road would not be required to go through this M-l district, but a road ,would be required in the Residential District 1000 feet back from he bluff. The Board will require dead end roads connecting u to the scenic easement. Mr. Schad said they would work \ on layou t and submi tit to the Board. * * * The Planning Board discussed with Richard Lark, Esq., the proposed change of zone for Leisure Greens, Inc. from "A" Residential and Agricultural District to "B" Liqht Business District, property situated at Main Road, Cutchogue. Mr. Wickham said the Board was told some things by Leisure Greens, Inc., that were not true. They said they talked to trades people in the Town but actually had not. Mr. Wickham said it was not a good plan to have the Sacred Heart School playground by the parking lot. The application must be forwarded to the Suffolk County Planning Commission. Edson, Esq., came before the Board in regard to a proposed minor subdivision for Clement W. Booth off North Lane, Southold. The map shows four lots on the', approximately four acres. The map showB another lot owned by Mr. Booth, but it is not contigious to the minor subdivision. Mr. Wickham told Mr. Edson the boundary of the subdivision must be marked in heavy lines and the map must show the names of the property owners acress the streets. * * * r ,ti I Mr. Peter Warren came before the Board and said that the owner and real estate agent for Laurel Country Estates has been 'telling people buying lots there that they have the right to use the beach (between the Sealy and Arthur homes). Mr. Warren submitted a copy of a letter sent to neighbors from the Boulevard Residen~s Association dated July 15, 1973, and a copy of the Planning Board minutes of March 24, 1970, of the public hearing for Laurel Country Estates. In the minutes the at~orney for Laurel Country Estates stated they would not deed out any beach rights with the lots. Mr. Warren said he would like the Board to write a letter to the developer. Mr. Wickham received the following telegram over the telephone in regard to this matter from Dr. and Mrs. Philip Ziring: "At the March 24 1970 meeting of the Southold Town Planning Board the map of the Laurel Country Estates Subdivision was approved without beach rights. In the last few weeks many of these Laurel Country Estates residents have chosen to defy this decision thus creating a health hazard and potentially dangerous confrontation with members of the Boulevard Residents Association who have deeded beach rights. As members of the Boulevard Residents Association we request the Town of Southold use whatever means it thinks necessary to enforce the March 24 1970 decision." Mr. Wickham told Mr. Warren the Board will look into the matter and take the necessary action. * * * "J I ; i Mr. Gus Schad and Dick Lark, Esq., appeared before the Board in regard to the site plan for condominiums for Brecknok Hall. Mr. Schad presented a new site plan for the buildings. Mr. Schad said he had found out that the Zoning Ordinance only allows four units per building and his plan is for eight units. The new site plan shows the buildings clustered and the parking area would be dropped down. Mr. told him there may be a problem with drainage. Mr. Lark under this plan he can't build. With the 145 acres he could have multiple \ residences on 30 acres and file for a subdivision on 70_ acres with a cluster. The advantage is to have the scenic easement and open space on the residential. Mr. Wickham \ said if the Ordinance says no more than four units we have no right to vary that at all. There are some ways of doing \~ it; you could in some way divide the units. Mr. Wickham said the multiple residence plan and cluster plan will have to be handled separately. Mr. Wickham said in this particular case he would have no objection to him going to the Board of Appeals. The Planning -Board is meeting with the Board of Appeals and would be glad to talk to i them about it. We would give a letter of recommendation. 'I Mr. Schad said this new plan is much different. There is no trouble with spacing and the density is the same. 1 Mr. Lark said they plan to tie in the roads, sewage, water i and drainage with the "A" cluster concept. Mr. Schad said ! they would be individual homes but under condominium ownership. ! Mr. Lark said by clustering they would save money on building \ and preserve open space. With condominium ownership then \ can share in the open space. Mr. Schad said there are 57 acres \ with the condominium area and about 30 buildable acres; the \ residential area is about 74 acres - with clustering about \ 36 acres would be left open in the "A" zone. Mr. Schad ~ left the new site plan map and Mr. Wickham said he would ~CU"" it with the :oard of A:peal' and. Town Board. Robert Tooker, Esq. and Jim Reeve came before the Board in regard to Little Neck Properties Subdivision. Mr. Tooker said the nitrate level had dropped and they have approval of the County Health Department. Because of the new amendment to the Zoning Ordinance changing the frontage to 150 feet their map does not now comply. All the lots are over 40,000 square feet and three lots do not have the required 150 feet frontage. Mr. Wickham told them the Town Attorney has said the Planning Board has no authority to approve anything that does not comply with the Ordinance. Mr. Tooker asked if the Board could recommend to the Board of Appeals to grant relief. He said they have another alternative and that is to revise the map. He presented a sketch plan of a cluster development with 11 lots, each having 40,000 square feet and approximately 140 feet frontage. The open space would be about 25%. Mr. Wickham: We want to follow this up. Mr. Lark: The engineer deliberately fixed that road to accommodate. He can't take all of it but he can take some of Indian Neck's excess water. Hr. Wickham: There is not a great deal of lineal distance but I understand a great deal of water originates far to the north and west and comes down here and this is not entirely his fault but we have to look at it and say what can be done to alleviate the situation. Mr. Raynor: Does anyone else have some information to bring before this board? Hearing none, has any board member anything else? We will declare this hearing closed. * * * Sea Breeze Village - Kontokosta Associates condominium units. v' Emmanuel Kontokosta, George Wetmore and Richard Lark, Esq., appeared. The following letter was presented to the board. Gentlemen: Attached is two copies of the proposed Condominium Site Plan, Scheme B, dated Hay 25, 1978 which I received May 30, 1978. In reviewing the site plan I see it complys to the Zoning Code of the Town of Southold. One suggestion, a wider road to the easterly parking area be made so cars may pass. /s/ George H. Fisher Senior Building Inspector Mr. Kontokosta presented an amended plan showing the right-of-way at 20 foot width. There was a question of a 100 foot setback from the bluff. The building inspector has to go by a 50 foot rear yard according to the Code but Mr. Wickham says the Planning Board can require a 100 foot setback. Mr. Kontokosta, at the Board's request, put the approximate top of the bluff in red ink on one of the plans. Lark in which he inquired about the roads to go into this property. William Schriever and Charles Cuddy, Esq., appeared. Mr. Schriever is negotiating an exchange of property in the area of the recharge and it was his contention that Supt. of Highways Dean and the Town Board had agreed in principle. He requested approval of the sketch map with the condition that the tovm approve the exchange of property which amounts to the sump area and the town approve the up-zoning for the area that is lots 7, 8 and 9. Mr. Schriever changed the wording on the map from 'preliminary' to 'sketch'. * * * Richmond Creek Farms. Arthur DiPietro, Esq., and Pat Frank Nesci, Esq., appeared. The following comments were made by Mr. Raynor. Meadow area is being used for park and playground. The names Cove Court and Cove Drive are confusing. Lots 37 to 43 are in the flood plain. Lot 14 is a flaglot. There is no recharge basin. The access to Lot 2 should be restricted to an interior road. Block from Main Road to Creek Lane is in excess of 1200 feet. Check out highway specifications with regard to 12 inch corrugated steel pipe. Mr. Raynor thinks it should be 18 inches. A dwelling on the property is not reflected on the map. Mr. Gordon asked if any consideration had been given to developing this property in the cluster concept. There was further discussion on this and the gentlemen will get back to the board. There was also something said about the possibility of swale drainage and getting recommendations from the Soil & Water Conservation District. * * * On motion made by Mr. Wickham, seconded by Mr. Gordon, it was RESOLVED to grant two extensions of 90 days each for the time to submit the final map of the subdivision known as "Centennial Manor. No major nonresidential structures, such as, swimming pools, garages, etc., shall be permitted to be constructed or located within 50 feet of the top edge of the bluff. 2. No grading shall be permitted within 50 feet of the top edge of the bluff except that that may be necessary to control or remedy erosion or to divert stormwater from flowing over the edge of the bluff. 3. Clearing and cutting of vegetation, particularly under- growth, within 50 feet of the top edge of the bluff shall be limited to that necessary for maintenance. 4. No sanitary disposal facilities shall be constructed or located within 100 feet of the top edge of the bluff. 5. No stormwater runoff resulting from the development and improvement of the subdivision or any of its lots shall be discharged directly over the top edge of the bluff or down the face of its slope in any manner. 6. Access to the beach at the toe of the bluff shall be restricted to a community access structure. Said access structure shall be designed and constructed in a manner that will result in the least disturbance to the stability of the bluff. 7. It is not the intention of the Planning Board that a turnaround be built at this location. * * * Cove Beach Estates. Richard Cron, Esq., and Howard Young appeared at the meeting. The recommendations and corr~ents of Lawrence M. ~ Tuthill, Town Engineer, were reviewed by the board and Messrs. Cron and Young. A copy of this report will be forwarded to Mr. Cron. Natural drainage areas without fencing were discussed and suggestion was made that the town could be indemnified in this regard. * * * . Brecknock Hall Condominiums. Richard Lark, Esq., Howard Young and Gus Schad appeared before the board. The proposal is for 385 units. The project will be developed in sections. Discussion has been held with the Village of Greenport Utility Superintendent and it is likely that both sewer and water will be available from the village. This will increase the number of units allowed. Mr. Lark stated there is a possibility a change of zone will be sought for the nine acres by the Sound which is zoned residential with no increase in the density verall. It \ access will have to be provided. The street circulation is poorly I designed. It lacks loop type circulation. There are no drainage facilities. There is an excessive overall block length. There areV no east side of the property connections. There are no elevations, on the buildings to determine the separation between the buildings. To comply they lack the 100 foot setback from Long Island Sound. Mr. Raynor feels the entire project should be reconsidered. Where it is so badly designed, Mr. Raynor feels the Board should go back and look at the total planned concept development. He would like to see expanded use of the Sound frontage areas and the density ~e cut by half or two-thirds. This information will be relayed to . Mr. Schad. ./ / Lanzer property. John Hutter has requested that the Planning Board review this property for a recommendation on whether he should proceed to request a change of zone from the Town Board. John Strong has requested information on the possibility of making the right-of-way in this minor subdivision 25 feet wide instead of 50 feet. He would also like specifications for completion of the right-of-way. It was his ~ 7\ opinion that here was no need for the right-of-way to be 50 feet in ,~\ width as this was excessive because there would be no need for this to become a town road for access to the interior lots of Gillispie, if it were 25 feet it would preclude it from being a town road and there appeared to be a problem of ownership and the possibility of it being lost for taxes and being taken over by the County. After discussion, it was the consensus of the board, with Mr. Latham in disagreement, that the right-of-way remain at the 50 foot width. * * * _0 Mr. Raynor announced that he had spoken to Mr. Kontokosta and he had indicated that he would be abandoning his plans to construct a marina at his Shipyard Lane, East Marion, property. He will proceed with plans for 48 condominiums.
