THIS INDENTURE,made the 29th day of January, ,nineteen hundred and sixty—two

ing at 87 - 11th Street, Garden City, New York,

party of the first part,and NDRTIMRR He CHUTE and DOROTHEA Be CHUTE, his wife,
both residing at 87 - 11th Street, Garden City, New York,
party of the second part,
WITNESSETH,that the patty of the first part,in consideration of
Ten ($10.00) - - - - - - - - - - - - - - - - - - - - - - - - -dollars,
lawful money of the United States, and Other gO0d and valuable consideration paid
by the party of the second part,does hereby grant and release unto the party of the second part,the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot,piece or pares!of land,with the buildings and improvements thereon erected,situate,
lying and being in the Town of Southold, Suffolk Countv, New York, at Nassau
Point or Little Hog Neck, and known and designated as Lot Number One
hundred and one (101) on map entitled"Amended Nap A of Nassau Point,
owned by Nassau Point Club Properties, Inc., situate in Town of South-
old, Long Island, N.Y." surveyed June 28, 1922 by Otto We Van Tuyl,
C.E. & Surveyor, Greenport, N.Y., and filed in the Office of the County
Clerk of Suffolk County, N.Y. August 16, 1922, file No. 156.
And the parties of the second part, for themselves, their heirs
and assigns, do hereby covenant to and with the party of the first
part, her heirs and assigns, that the parties of the second part,
their heirs and assigns, will not at any time erect any house on said
j premises costing less than $3000.00 each, except the ordinary out
houses, and that not more than two such dwellings shall be erected
on said premises.
The foregoin¢ covenants, restrictions or reservationsmay be
altered or annulled at any time by agreement between Nassau Point Club
Properties, Inc:, and the owner for the time being of the premises
hereby conveyed, and such agreement shall be effectual to alter or
annul said covenants, restrictions or reservations without the consent
of the owner of any adjacent premises.
Being and intended to be the same premises conveyed by Katharine
Baylis Tuthill to Harold C. Schmidt (now deceased) and Dorothea Be
Schmidt (now by remarriage Dorothea Be Chute) by deed dated November
14, 1955 and recorded in the Suffolk County Clerk's office on
November 29, 1955 in Liber 4028 of Deeds at Page 107.
