BETWEEN CLIFFORD T. CASE, residing at 26 Brittany Court, Northport,
New York, KATHERINE R. CASE, his sister, rosidtg at 3600 Park Avenue,
Apt. 4D, Wantagh, New York, and DAVID T. CASE, ding at 407 Shannon
Street, Schenectady, New York, presently residing at RD #3, Hickory
Ridge Road, Ballston Lake, Saratoga County, New York,
party of the first part,and THOMAS L, SHALVEY and ELIZABETH J. SHALVEY, his wife,
as tenants by the entirety, both residing at Dopot Lano, Cutchogue,
Suffolk County, Now York,

WITNESSETH,that the party of the first part,in consideration of

BEGINNING at a point on the southerly line of Case Road, South 76
degrees 58 minutes 20 seconds East, a distance of 125.0 feet from the
intersection of said southerly line of Case Road with the easterly line
of Bay Road (which point is the northwesterly corner of the promises
herein described and the northeasterly corner of premises heretofore
conveyed by the parties of the first part to the parties of the see and
part by deed dated September 17, 1963 and recorded in the Suffolk
County Clerk's Office on September 30, 1963 in Liber 5423 of Deeds at
page 263); running thence along the southerly line of Case Road, South
76 degrees 58 minutes 20 seconds East, a distance of 100.0 foot to land
of Ruth B. Case; running thence along said land of Ruth B. Case, South
13 degrees 01 minute 40 seconds West, a distance of 150.0 feet; running
thence along other land of Clifford T. Case, Katherine R. Case and
David T.Case, North 76 degrees 58 minutes 20 seconds West, a distance
of 100.0 foot to the said premises heretofore conveyed to the parties
of the second part; running thence North 13 degrees 01 minute 40
seconds East, a distance of 150.0 feet to the point or place of be-
ginning.
TOGETHER with a free and unobstructed use, in common with other
owners, over a right of way for passage on foot over a certain private
road 2 rods in width running from New Suffolk Avenue in a southerly
direction to Peconic Bay, said right of way being bounded north by
Now Suffolk Avenue, east by lands now or formerly of Beverly King,
south by Peconic Bay and west by lands now or formerly of G. H. Case
estate.
SUBJECT to covenants and restrictions as set forth in SCHEDULE "A"
attached heroto and made a part hereof.
