POPE, his wife, party of the second part, both of 20 Sherman Avenue, in the Borough of Waldwick, County of Bergen and State of New Jersey, WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable considera- tion paid by the party of the second part, does hereby grant and release unto the said party of the second part, the heirs or successors and assigns. of the party of the second part, forever, ALL that parcel of land on the northeasterly side of Westphalia Road at Mattituck, Southold Town, Suffolk County, New York, bounded and described as follows: Commencing at a monument set on the easterly line of Westphalia Road at the southwesterly corner of lands of Seymour H. Tuthill Estate and running thence along the southerly line of lands of Seymour H. Tuthill Estate, N. 390 42' E. 124.84 feet to a post; thence along the same lands N. 460 45' E. 154.44 feet to a post; thence along the same lands through two oak trees and a monument N. 450 58' 20" E. 430 feet more or less to Ma ttituck Creek; thence southerly along Mattituck Creek 63 feet more or less to a point; thence S. 450 58' 20" .West 450 feet more or less to a locust stake; thence S. 460 45' W. 151.15 feet to another locust stake;thence S. 390 42' W.116.34 feet to a monument on the easterly line of Westphalia Road; thence N. 540 52' 30" West along the easterly line of Westphalia Road to the point or place of beginning. TOGETHER with all the right, title and interest of the first party of, in and to land lying within the bounds of Westphalia Road and Mattituck Creek adjacent to said premises. Together with a right of way over the farm road as it now stands over lands now or formerly of William B. Reeve adjacent to the above described premises to Westphalia Road. This right of way, however, shall inure to the benefit only of that part of the above described premises as Is within 200 feet distance of the shores of Mattituck Creek; no such right of way is intended to pass with any of the remaining part of the above described lands. The said William B. Reeve reserved the right at any time to change the alignment of said right of way and said reserve- tion esew - tion shall pass to his successors in interest. SUBJECT TO the following: 1. Any state of facts an accurate survey or inspection of the premises might show. 2. Rights of others, if any, in lands lying within the bounds of Westphalia Road and Mattituck Creek adja- cent to said premises. 3. Rights of others in right of way over the 2rm road as described in deed by William B. Reeve dated April 1, 1941 and recorded in the Suffolk County Clerk's Office in Liber 2215 of Deeds, at page 314. LIM556L PAGE361 BEING the same premises conveyed by William B. Reeve to Irving W. Pope by deed dated April 1, 1941 and recorded in the Suffolk County Clerk's Office April 2, 1941 in Liber 2155 of Deeds at page 314. The said Irving W. Pope died a resident of Bergen County, New Jersey,testate, and devised said premises to the grantor herein. THE INTENT and purpose of this deed is to cause the title to the above premises to be vested in John I. Pope and Anna L. Pope, his wife, as tenants by the entirety.
