THIS INDENTURE made the P day of October, 1964, - between the TOWN OF SOUTHOLD, in the County of Suffolk and State of New York, by a majority of its duly elected Trustees, and in pursuance of Chapter 615 of the Laws of New York passe in 1893 as amended and in pursuance of a written resolution adopted by a majority of the Board of Trustees of said Town of Southold at a meeting held pursuant to notice duly given j to all members thereof on the " day of October, 1964, party 1 ! of the first part, and JOHN F. BURNS of Mattituck, Suffolk I ) County, New York, party of the second part, 1: WITNESSETH, that the party of the first part in consideration of the sum of One ,. ( 1.00) Dollar to said Town duly paid before the delivery hereof doth hereby remise, re- lease and quitclaim unto the said party of the second pert, his successors and assigns forever, ALL that certain tract, piece or parcel of land situate, lying and being at Mattituck in the Town of Southold, County of Suffolk and State of New York, generally bounded and described as follows: BEGINNING at a point marking the northeasterly corner of the within premises, which point of begin- ning is situated S. 290 30' E. 205.00 feet from a monument set on the southerly side of 'Westview Drive and which monument marks the northwesterly corner of land of Sellars, formerly Hamner, and the northeasterly corner of land of Burns and from said point of beginning running S. 290 30' E. 110 feet, more or less, to the high water mark of Mattituck Creek and running thence westerly along said high water mark to a point, which point is situated S. - 240 00' E. I30 feet, more or less, from the south- westerly corner of land of Burns, and running thence N. 240 00' W. 130 feet, more or less, to a point and land of Burns, running thence along said land of Burns N. 620 16' 10e E. 83.77 feet to the point or place of beginning. Being and intended to be all of the "filled area" lying between the high water mark of Mattituck Creek as found in 1950 and the present high water mark immediately adjacent to and lying to the south of the land of the party of the second part.
