Please be advised that the following resolution was passed by
the Southold Town Planning Board at their regular meeting held
on July 19, 1971~
IT WAS RESOLVED that the Southold Town Planning Board grant
final approval to the revised site plan of proposed "Mattituck
Shopping Center" with Post Office connected to the shopping
center complex as originally planned. This plan has all
buildings attached in a contiguous manner. The main sidewalk
and parking area remain the same as previously approved. The
southerly entrance on Factory Avenue has been eliminated.
Enclosed please find copy of approved revised site plan as
signed by the Chairman.

RESOLVED that the Southold Town Planning Board refer the
site plan of Mattituck Theatr~ for the construction of 2 additional
theatres, located in the Mattituck Shopping Center to the building
department for certification.
Please forward three (3) additional copies of the site plan
for our referral to the building department.- Please, also, forward
the filing fee of $50 at your earliest convenience.

Also submitted is a scalod down version of the signage
that appears on the elevation drawing. We trust that these
requested changes will satisfy [he Board and H'r. ['isher
can immediately issue the building permit.
If you could please have your staff issue a memorandum

Gentlemen:
I have a proposal for Theatre #3 to be added and
included with the business of the existing Twin Theatre.
This is to be Theatre #3 which is proposed to occupy
2880 sq. ft. of the formerly used retail sale area. At 100
sq. ft. per sale area for a parking space it would call
for 29 spaces.
The proposed Theatre is to have 299 seats. At 5 seats
per 1 parking space, this would call for 60 spaces.
The Theatre would require 31 more spaces then the
retail sale area. There is large building areas unoccupied
In the future when they are occupied, parking should be
compared with the original approved parking plan.
I will need your approval before any permit can be
issued for Theatre #3.

Pursuant to your request, I am forwarding this letter acknowledging
that the above captioned request for theater expansion with parking
variants has been scheduled for the June 1st meeting of the planning
board at 8:15 p.m.
George Fisher has instructed me that our construction permit for
theater expansion cannot be issued until the planning board has
officially resolved to allow the expansion even though the
number of parking spaces within the center based upon total
occupancy has exceeded the maximum permitted. An informal meeting
with Henry Raynor on May 13, indicated a personal opinion that
due to the fact that the theater is primarily a night time business
it would not interfere with parking for the day time retail
operators.
I am hopeful that this letter will allow a review of the matter
prior to the June 1st meeting in order that the board may render
a decision at that time. Understandably, our hands are tied and
no construction can begin until this matter is resolved and the
appropriate building permit issued.
Although I do not have building site plans, they are available
through Mr. Fisher at the building department. I do have the
architectural plan submitted to Mr. Fisher for the theater expansion
and a survey of the property should they be required for review
by the board. Please advise me whether the theater plan and survey

alleyway at the Mattituck Mall the Board of Fire Commissioners of the
Mattituck ?ire District has discussed the matter and investigated the
firematic impact this would have .
Their view is that any access to a fireground that might occur
should be protected, therefore, the board would would recommend that
this particular access be preserved.

Dear Mr. Weiner:
This is to certify that Mr. Messimo F. Yezzi, architect,
builder, and developer of Mattituck Shopping Plaza received
site plan approval from this Board on this shopping center
on July 19, 1971 and, subsequently, altered the plans and
proceeded to build without submitting an amended site plan
or building plans.
Since the unauthorized alterations involved substantially
lowering the finished elevations, as well as changing the
entire appearance of the buildings, work was held up twice
by this Board and allowed to proceed only aftmr complete and
extensive architectural and engineering revisions. These
revisions entailed hundreds of thousands of dollars of
additional construction costs.
This Board further certifies that it never even saw
altered site plan and building plans until they were produced
by the succeeding owner-builder as a plan which Mr. Yezzi,
allegedly, told the new owner-builder had been approved by
this Board.

Dear Mr. Frankel:
In support of our telephone conversation of today and
in regard to the Architect for the Mattituck Shopping
Plaza, Mr. Yezzi, I should like to submit the following~
Mr. Yezzi as architect for this project lowered the
finished floor elevation of the entire construction project
about 2 1/2 feet without submitting a revised plot plan as
required and proceeded to pour footings for the buildings
and prepared to effect the steel based on an unauthorized
design.
Since the finish floor elevation of the original plot
plan approved by the Planning Board on July 19, 1971, and
signed by myself as Chairman was only about 8 feet above
sea level and since at least 3 feet is normally required on
storm drainage structures for cones and gratings as well as
gradient it must be obvious that he reduced the effective
depth of the drainage structures by over 50%. In other words
the drainage fields became hopelessly inadequate. In fact the
subsequent owner, Mr. Cassella, had to more than double the
number of drainage structures provided for in the approved site
plan at tremendous expense to himself.
If Mr. Yezzi has made a statement that he, in fact,
submitted a revised site plan to the Building Inspector and the
N.Y.S. Dept. of Education - 2 - April 20, 1973
Planning Boar~ I can only say that it was never received.
I can go further since there has been one more
development.
In October 1972, after the buildings began to take
shape, I personally noticed that the roof lines were not
of the Colonial type as shown on the approved site plan.
I stopped at the job superintendent's office and he produced
a front elevation drawing by Mr. Yezzi showing a French
Provincial motif. The superintendent assured me that
Mr. Yezzi had said that this design had been approved by the
Planning Board. I had never seen such a front elevation
before nor had any member of the Planning Board nor the
Building Inspector.
Needless to say the present owner was required to stop
all construction on this part of the project, to redesign
the roof lines of the central part of the shopping plaza,
submit the plans for approval to this Board and eventually
was allowed to proceed with a Colonial type motif.
In protesting the actions of Mr. Yezzi I am not at all
motivated by any urge to make it difficult for him because
of the trouble he has caused. Rather I wish to be assured
that other municipalities and other builders may be spared
the problems he has caused us and that our hard won experience
will do somebody some good.

In accordance with your direction, I have re-
viewed the installation of drainage facilities on the above
captioned with ?Ir. George Fisher of the Building Department
of the Town of Southold.
Mr. Fisher furnished me with a copy of a plan dated
January 23, lO73 prepared by him to show the leaci~ing pools,
which had been installed. He stated that this plan substantial-
ly reflects the location of the pools. He also reviewed Dian
with me designating the size of each pool. Mr. Fisher pointed
out the location where fifteen (15) i)ools are now being instal-
led and the area i~l which he was advised by the Superintendent
of construction where twenty (20) additional pools are to be
installed.
When the plan entitled "t{evised grading and drainage
plan for the Mattituck Shopping Center, Mattituck, New York"
prepared by John A. Jacobsen ~ssociates, with the latest re-
vision date of September 21, 1972, was filed with Howard Terry,
Building Ins~ector, a copy of which was transmitted to me on
geptemb~r 26, 1072, the plan showed two (2) "Systems A and B"
of leaching pools and "System D" of leaching pools. "Systems
A and B" was to receive all of the storm water drainage from
the roofs of the buildings, parking areas in front and in back
of the buildings and from Factory Avenue, except storm water
drainage from a small area at the northeast corner of the proper-
ty where the storm water run-off would flow to "System D".

of John A. Jacobsen associates provided 131,312 cubic feet
for " o B'
Systemo A and and Factory Avenue.
This system would be 20,061 cubic feet of volume
less than that which had been requested or required. This
amount translated another way would mean that the additional
required number of pools, each of a size of 4 feet hi~h, 12 feet
diameter with iow dome, would be forty-one (41) pools. Using
areas of coefficient of run-off heretofore used, this system
would contain ~ rain fall of 2-3/8 inches.
The pools installed in "System D' have a volume of
2,00k cubic feet. The plan ha~ mrovided for the system to
contain 2,015 cabic feet.

On January 11, 1973 you had furnished me with
a copy of the aforesaid plan on which was penciled ac-
cording to a notation by Joseph Cypoath proposed revisions.
He showed t~at certain pools were to be eliminated and the
locations of additional pools. The pools which are shown
to be lock, ted between existing lines of pools should not
be installed because these pools would be too close to~ether
thereby retarding seepage. On this plan he had indicated ad-
ditionsl 8 inch pipes connecting certain pools. These pipes
should be installed. This revised plan with the sdditional
pools is not conforming to the heretofore set forth statement
of Mr. ?isher as to the location of pools yet to be installed.
Mr. Fisher pointed out that all of the pools are
connected and that, if there was a rainfall which required
the filling of all pools, air would be entrapped in certain
pools causing a time delay in filling because the air would
have to be expended through the eart~ surrounding the pools.
It is therefore suKgested that you require that cast iron
inlet frames and grates be installed on certain pools. This
will take care of the problem which Mr. Fisher has Dosed and
will also allow for some water to enter the system from other
pools rather than the few which had been provided. I would
su~gest the cast iron inlet frames and grates be installed in
the a~proximate center of each line of pools running east and
west but not directly in a north south line. It is difficult
to pin point the location until either a definite plan has been
prenared or the pools have been installed.

Mattituck Shopping Center, Inc.
My client recognizes its obligation to landscape the
property which it is now developing into a shopping center.
I am advised by my client that a landscaping plan is
being prepared for submission to your Board for its
consideration and approval. It is my client's intention
to properly landscape the premises as soon as is practicable.
My client will also install three storm drain catch basins
with necessary piping to the drainage system which will be
provided in the parking field. Such catch basins and piping
will be installed within the curb lines of the east side of
Factory Avenue, in between the two proposed curb cuts as
shown on the latest site plan and will be the subject of
consultation with Mr. Dean of the Town Highway Department.
After said consultation, the necessary addition to the site
plan, reflecting such installation, will be submitted to you

an additional ten pools in the parking field area in connec-

has caused considerable discussion. I might even
say that I have never before senn such an uninformed
nor ill-timed letter from an attorney.
In the first place all of the eight conditions
agreed to by your client and his attorney and presented
to this Board and its attorney (Agreement of July 19,
1972) have not been met.
In consideration of the hardship and the time
required to check the last set of maps this Board
lifted the stop order temporarily. At this time it
appears that the site plan for drainage is not adequate
and will have to be revised again. This may even
nullify the O.K. of the County Health Department.
Perhaps your client did not tell you that subsequent
to our July 19th "Agreement" our Building Department
found that your client had exceeded the total area of
buildings shown on the approved site plan by over a
thousand square feet. This, too, the Board was in the
mood to adjust out in terms of more detailed landscaping
and a special landscaping site plan to be presented and
landscaping in fact completed before a Certificate of
Occupancy will be issued. All the above was agreed to
by Mr. Cassella and is a part of our minutes.

stop order should not be re-instated - or raised - if in

My associate, Norman N. Liberm~ Esq. and my client, Mr. Thomas J.
Cassella entered into an agreement with the Southold Town Planning
Board dated July 19, 1972 wherein the Contractor (Mattituck Shopping
Center, Inc.) agreed to eight (8) items of procedure in lieu of the
requirements of the site plan originally aporoved by the Board.
Mr. Cassella tells me that he has complied with all of the requirements
of that agreement. He further informs me that he has received the
complete approval of the Health Department to the present location of
all pools etc.
All of the extra work entailed therein was as consideration for an
approval of the departure from the approved plans. Mr. Liben has
informed me that the discussion was quite complete and covered all of
the requirements of the board. Now that the additional work has been
substantially completed, to require items over snd beyond that agreed,
and items which could not possibly be my client's problem, is not only
unfair but contrary to the spirit of the agreement. The requirement of
pool6 under the public highway adjacent to the premises is an arbitrary
requirement, in the nature of an afterthought. At this point, you have
placed my client in a position where increased unreasonable and unwarranted
demands become so costly as to amount to a deprivation of property.
We have come so far relying on the agreement as expressing our total
responsibility that we can no longer resort to the original alternative
of complying with the original plans.
The work called for in your letter of July 31, 1972 will cost an
additional $70,000 and is not "minor" as you state in your letter. In
addition your letter of July 31 is in error since there are no pools
of any sort in the buffer zone. The original contract between us did
not call for the work you want in respect to the elevation problem of
the ros~. This is R town problem and not thst of a private contractor.
Your letter refers to subdivision requirements. These have never been
furnished to us or ever referred to by any inspector etc.

Yezzi, No. 6338, should be revoked for malpractice.
Specifically, he submitted a site plan for a shopping
center to be located on N.Y. Route 25, Mattituck, New York
in this Town which was approved by this Board and signed
on July 19, 1971. At this time he informed us that he
would himself build the facility.
Construction was begun in the fall of 1971 with the
laying of the foundations and erection of steel. At this
point construction stopped and he apparently conveyed his
interest to a third party, Thomas Cassella. A rough check
by our Building Department indicated side yard distances
were adequate.
Cassella resumed building this spring and it soon
became evident that the site plan was not being followed,
and a stop order was issued on this Job by the Building
Department. We have engaged a reputable engineer to
determine exactly at what points construction deviates from
the approved site plan and the salient points are that the
finished floor elevation is almost three feet too low and
the building is some 2000 feet too large.
Not only did Yezzi dispose of some thousands of yards
of fill from the site resulting in an unauthorized lower
setting, but he also used an assumed ground water level

which has proven to be two feet too low. These two
factors result in a net loss of nearly five vertical
feet of available drainage. In this case it meant that
of the drainage designed by Yezzi in the approved site
plan, over 60% was non-existant.
The new owner assures us that Yezzi told him that

but this is not the case.
At the present time it appears that the new owner
will incur an extra expense of approximately $200,000
to install the additional drainage required by our
specifications. In addition he may be required to cut
down the 2000 square feet excess building and may yet
have to correct any deviations from the approved site
plan which we may not have found as yet.
It is our feeling that we have enough trouble with
'honestu errors without this kind of manipulation. It
is also obvious that Yezzi in acting as both architect
and builder had unusual opportunity to make unauthorized
changes.

The Planning Board has received the drainage and
sewage plat plan from the County Department of Health
with their approval subject to alterations as marked
A, B and C.
We note that all of the 50% expansion is in the
buffer or reserve area. As per our agreement we will
only allow 10% of these structures in the reserve area.
We have submitted to Young & Young one set of
these prints and requested that he not only compute
the respective drainage areas but also recompute the
storm water drainage (1) on the northern buffer zone
on the basis of 50% runoff due to the excessive slope,
(2) on the parking area on the basis of 100% runoff
instead of 90% on all areas of over 3% slope, and (3)
the arua to the west and north of this property to a
distance of 200 feet. Most of this area is across
Factory Avenue and the basis can be a 5 inch rainfall
but a 40% runoff.
You will note that this last item is clearly covered
in our subdivision requirements and further that each of
these items were discussed with you by this Board.
In view of the above changes, all of which we
consider minor, the Board is prepared to extend the time
for you to submit an approved map by 15 days, enabling
us both to make the necessary changes in the map.

WHEREAS the Contractor is engaged in the construction
of a shopping center located on the north side of Route 25,
~attituck, New York, and
WHEREAS the Building Inspector of the Town of Southold
has stopped all construction on said site by reason of the fact
that construction has not proceeded in accordance with the site
plan approved by the Board, and
WHEREAS the Board and the Contractor have met at a
meeting of the Planning Board on July 18, 1972, and the parties
have agreed that the Contractor shall be permitted to resume
cDnstruction on the said site subject to the terms and conditions
hereinafter set forth, to wit:
1. The Contractor shall submit a redesign of the
parking lot with less that 6% pitch by installing a retaining wall
around the gas station on the southwest corner of the premises
which shall require a minor change in the storm water drainage
system.
2. The Contractor shall redesign the storm water system
in accordance with the letter of Alden W. Young, engineering
consultant of the Town, dated July 18, 1972.
3. The Contractor shall redesign the sanitary disposal
system for twenty-two (22) foot ground water elevation with not
more than 10% of the structures in the reserve buffer zone and none
of such structures requiring servicing. Such redesign must be
approved by the Suffolk County Department of Health and shall have
not less than one-quarter inch pitch.

4. The Contractor shall redesign the grade of the
buffer zone on the north side of the premises which shall include
a three foot retaining wall and grass and plantings.
5. The Contractor was given permission to install the
stand.~.~.~.~pipe in the buffer zone provided that the.same is located

facilities accessory thereto shall be properly landscaped with
trees of not less than 20 feet in height.

approval of the Suffolk County Department of Health, where such

I have very carefully reviewed these plans checking
the various areas which would drail~ to the various leaching
pool systems, and found Systems A, B a~d C to conform to
the design criteria, in System D, which is for the ramp
area at the northeast corner of the buildings~ the top of
the inlet frame is at elevation 26. The leac~i~ pools de-
signed for this area were to consist of a ~' ring a~d with
a low dome. As the dome would be above the top of the inlet
frame, no credit should hsve been allowed for storage in the
dome. To meet the criteria one more ~' by 12' leaching pool
should be ~rovided and domes eliminated.
The typical drainage system shown o~ tho plan is appll-
cable only to oystem B. ~he other systems are designed to
have only a ~' rin~, otherwise the top of the pools would be
above the finished grade. There were no dimensions shown
on the catch basin pool for the thickness of cover or the
roadway type frame and grate. I called Mr. Gondolfo, and he
advised that ti~e cover would be 8" and the frame and ~rate
would be ~" in height. Theoretically, this would mea~ the
elevatlon of the catch basin pools would be 29.1~; however,
he could set the frame and grate into the cover oy 0.1' and
meet the elevations as shown on plan.
~lthough i have mentioned a c:~uole o£ very ~inor
corrections, because I have c~refully reviewed this ~lan,
I would state that the plan meets substantially the design
criteria.

The plans for the above referenced site was approved by
the undersigned on 6-14-72. Recent inspections indicate that the in-
stallation of the sanitary disposal systems are progressing according
to the approved plans.
It is not possible at this time to determine whether more
leaching facilities may be required or not until all the piping has
been installed. However, it is the opinion of this office that the
necessary land exists for future expansion. Therefore, it is felt
that an adequate sanitary disposal system can be installed.

the sewage disposal facilities and the water supply have been

Special meeting of Southold Town Planning Board was held
at the Town Clerks Building, Main Road, Southold, New York,
9:30 A. M. - E. D. S. T., Monday, July 3, 1972.
Present were: John Wickham, Chairman; Henry Moisa, Vice-
Chairman; Henry Raynor. Also present~ were: Howard Terry, Build~
ing Inspector and Alden Young P. E., ~etained by the Planning
Board as Special Consulting Engineer.
Mr. Young brought his record of Survey and Topographic
Elevations taken at the site of Mattituck Shopping Center Inc.,
Fact0ry Avenue and Main Road, Mattituck, New York.
The Building Inspector produced the file of the Planning
Boards approval of the site plan for the Mattituck Shopping Cen-
ter Inc. as approved for Mr. M. F. Yezzi, Architect and reputed
owner of premises dated July 19, 1971; and the building permit
file with Health Department approval for the sewerage disposal
plans; and a proposed drainage plan as submitted by ~an Boccard
of 145 West 11 Street, Huntington Station, New York.
A comparison of these plans show a descrepancy of about 3
feet in elevation between the site plan as approved by the
Planning Board on July 19, 1971, and the drainage plan sub-
mitted by The Boccard Co., Thurday June 29, 1972. Also a
descrepancy between the sewerage disposal plan approved by the
Health Department and what was found by "on site" inspection
Friday, June 30, 1972, P. M.
On Friday P. M., a stop-work order was issued by the
Building Inspector effective immediately. The premises were post-
ed and notice mailed to the current owner-builder at his office
504 Walt Whitman Road, Huntington Station, N.Y. by Certified
Mail, Return Rec~pt Requested.
The site plans and elevations w=~= carefully examined and
it was determined by comparison with available plans that the
building has been lowered about 2 feet 9 inches below the app-
roved elevation of July 19, 1971, this was confirmed by Mr.
Young.
The drainage problem was tkxoughly discussed, and it was
found that the sewerage disposal system as installed is not as
approved by the Health Department and has water in the bottom of
the pools.
A call to the Health Department, Mr. Jewell in Robert Villa~
office, confirmed that the installation has not be approved to
date.
A motion was made by Henry Moisa and seconded by Henry
Raynor and unanimously carried that the developer meet the re-
quirements and construct facilities as on the approved site
plan dated July 19, 1971.
A copy of this Resolution to be sent to the developer by
Registered Mail, Return Receipt Requested.
Further discussion on the sewerage disposal and drainage
was'held.
It was agreed to request further investigation by the Health
Department and copy of their approval of any revised plan.
The Planning Board authorized Mr. Young to do another
Topographic Survey as of today; this is to include depth to
ground water, location of installed pools and other "inground
structures" together with distances from property lines of any
and all of above.
A "Building Location Survey" of the building on the lot
has been received and re~wed and found to be as approved on
site plan of July 19, 1971.
The B~rd decided the elevation of the building and lot
should be raised to the original elevation approved July.19,
1971, as this will allow for a workable sewerage disposal plan
and workable drainage plan.
