This site plan is for a new proposed home medical office including a 1,700 sq. ft. first floor doctor's office and a 1,700 sq. ft. second floor of living quarters on a 1.25 acre parcel in the R-80 Zoning District located on Central Avenue, 100' e/o Mansion House Drive, on Fishers Island. SCTM#1000-6-6-20.7 WHEREAS, the applicant, Island Health Project, Inc. proposes a new home medical office including a 1,700 sq. ft. first floor doctor's office and a 1,700 sq. ft. second floor of living quarters on a 1.25 acre parcel in the R-80 Zoning District; and WHEREAS, Fishers Island Utility Company, Inc. is the owner of the property known as SCTM# 1000-6-6-20.7 located on the Central Avenue, 100' e/o Mansion House Drive, on Fishers Island; and WHEREAS, on July 27, 2004, a formal site plan application was submitted for approval; and WHEREAS, on September 7, 2004, the Southold Town Zoning Board of Appeals granted a variance as described under Appeal Number; and Island Health Project— Page Two — 04/12/05 WHEREAS, on September 24, 2004, the Fishers Island Fire Department has determined that fire wells are not needed in this area and the Planning Board has accepted this recommendation; and WHEREAS, on November 9, 2004, the Southold Town Planning Board, acting under the State Environmental Quality Review Act (6 NYCRR), Part 617.5 © 7, made a determination that the proposed action is a Type II and not subject to review; and WHEREAS, on December 20, 2004, the Southold Town Engineering Inspector reviewed the proposed drainage and issued conditions and the Planning Board has accepted his recommendation and incorporated the conditions; and WHEREAS, on January 3, 2005, the Suffolk County Department of Health Services approved the site plan under Reference Number C10-04-0003; and WHEREAS, on March 3, 2005, the Architectural Review Committee reviewed and approved the architectural drawings, associated site plan materials and the Planning Board has accepted this approval and determined it to be satisfactory; and WHEREAS, on March 9, 2005, the Southold Town Building Inspector reviewed and certified the site plan for "Home Professional Office' use; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, the following two items are incorporated and included in the site plan: 1. All outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. The lighting must meet the Town Code requirements. 2. All signs shall meet Southold Town Zoning Codes and shall be subject to approval of the Southold Town Building Inspector; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board grant final approval on the site plan prepared by CME Associates Engineering and Land Surveying, PLLC and certified by Richard H. The client felt that the original diagonal path was a greater distance than a straight path leading from the loading area to the nearest ADA door, and the client also had concerns regarding plowing the angular walkway. The proposed critically important Doctor's Office and related living quarters is a colonial shingle style building much in keeping with the surrounding structures. The materials will be red cedar shingle walls with traditional wood-fivned double hung windows. The trim will be a painted"green"color as submitted earlier, The roofing material will be asphalt shingles(40 years)for excellent maintenance control. This too is in keeping with the surrounding structures. 2. The heating will he gas fired radiant beat with an additional air condition system with a related corepressor/condenser located under the exterior staircase. The exhaust for the gas fiunace will be a typical wall mounted exhaust system. 3, The venting for the attic will be through gabled-end vents for a more traditional look vs. ridge vents. The only other protrusion will be a septic system vent through the roof on the"backyard" side for aesthetic value. 4. There will be no masonry accent walls or chimneys. 5. There wil l be one copper clad awning over the rear entrance where the Ambulance can pick up or discharge patients with the added protection from rain and/or sun The front entrance consists of a small porch over-hang with column support. The columns will be painted FRP to match the"green"trim. Again this will provide protection from inclement weather as well as from sun. 6. There is proposed a completely aesthetically pleasing sign(24" x 18")in carved wood with contrasting letters indicating the Dr.'s Office. As is the usual case on Fishers Island,this proposal has been studied and refined for a lengthy period of time. The Island Health Project has done due diligence in developing this plan for this critically important addition to the Fishers Island infrastructure. They have addressed all aspects of introducing a new structure to the village. The structure tits into the surrounding environment in a sensitive way so that upon completion, it will look like it has been there for a long time. The department must be notified at least 48 hours in advance to schedule an inspection by calling 852-2097; and excavation inspections must also be confirmed by calling 852-2100 prior to 9:30 a.m., the morning of the inspection. Article VII of the Suffolk County Code, "Septic Industry Businesses," requires that all installers of septic systems within Suffolk County shall possess a valid license from the Suffolk County Office of Consumer Affairs. This office can refuse to perform inspections or grant final approval for the construction of projects that are installed by an unlicensed individual. It is, therefore, in your best interest to utilize a cesspool contractor with a valid license to avoid substantial delays in your project. Final approval issued by the Department is necessary prior to the occupancy of new buildings, additions to existing buildings, or for the use of sewage disposal or water supply systems. Property Location: North Side of Central Avenue, Fishers Island CTM 6-6-20.7 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 1.25+- acre parcel has 186.43 feet along Central Avenue with 229.86 feet along the westerly side and 324.82 feet along the east side. The property is located in the R-80 Residential Zone District, and is located approximately 100 feet east of Mansion House Drive. BASIS OF APPLICATION: Building Department's March 16, 2004 Notice of Disapproval, amended April 8, 2004, citing Section 100-244B, in its denial of a building permit to construct a new dwelling with an accessory doctor's office. The reason for the disapproval is that Section 100-31 C.2 allows a "home occupation, including home professional office and home business office, provided that such occupation is carried out in an area not to exceed twenty-five percent (25%) of all floors of the main building, and in no event shall such use occupy more than five hundred (500) square feet of floor area," and 100-31 F, "...shall in no event be deemed to include...clinics or hospitals." The doctor's office measures 1,650 square feet in total size and encompasses more than 50 percent of the total building. By design, the building appears to be a "health clinic" as opposed to a doctor's office. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 19, 2004 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct a two-story residence and home office as shown on the survey prepared 9/2/03, revised 3/31/03 by Richard H. Strouse, and construction diagrams prepared 5/26/04 by Haven Homes. The home office would take up about 50% of all floor areas in the new dwelling and would exceed the 500 square foot maximum permitted by the code by approximately 1200 square feet. The applicant, Island Health Project, Inc. is the contract vendee of the property and is proposing a single-family residence with accessory professional office areas. The purpose of the spacious work areas for the doctor and his staff is to provide a full range of medical care services to those visiting, working or living on Fishers Island. The design of the doctor's office areas is not for a group of specialists whose outpatient practice is confined to a single building, or a substantial facility such as a hospital or institution involving multiple doctors. The proposed doctor's office will have a doctor and a single assistant, with two or more examining rooms, waiting room and other spacious work areas. The parcel to the north is improved with a house situated on the northerly section of that lot, with access from Crescent Avenue. The adjacent vacant land consists of 1.3 acres, planned by the owner (Goss) as a donation to the applicant's purposes in the future. The 1.3 ai res to the east is vacant. Across the street is an open field (baseball/recreational). Not far from :his property is the Hamlet Business zone to the southwest, and Limited Business Zone District to the northeast. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to these nearby properties. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Without a variance, sufficient work space would not be possible for the doctor's office, examining rooms, waiting room, handicap areas, and other floor area. The purpose is to provide medical services 24 hours a day, seven days a week, which is absolutely necessary for seasonal and small year-round population Fishers Island. 3. The relief requested is substantial. The code limits the size of a doctor's office as an accessory to a single-family dwelling to 500 sq. ft., including all work areas, and proposed is a doctor's office with handicap access facilities and related areas, totaling 1700+- sq. ft. 4. The difficulty was not self-created. The plan for a doctor's office relates to the needs on Fishers Island for nearby medical services, with a modern, up-to-date floor plan. The difficulty is related to the restriction of current Town Code requirements regarding the limited size in relation to the overall size of the proposed dwelling with a further limitation of 500 sq. ft. 5. No evidence has been submitted to suqgest that a variance in this community will have an community is outweighed by any other benefit because the physician's office will serve all of Fishers Island. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a doctor's office, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
