(631)765-1809•Fax(631)765-9064 d I .:1-11p,07, M lbttaeze FINDINGS, DELIBERATIONS AND DETERMINATION Southold Town Clerk MEETING OF APRIL 19, 2007 ZB File No.6000—VICKI HAUPT Property Location: 2200 Central Drive, Mattituck CTM 106-1-25 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicant's property consists of 56,156 square feet, inclusive of the sloped (unbuildable) areas between the top of the bluff and the high water mark of the Long Island Sound. The property has 120 feet along Central Drive where it meets Linda Road, and it is improved with a single-family dwelling constructed in two-building sections, as noted in Certificate of Occupancy Z-792 dated July 22, 1960 and May 23, 1960 Building Permit No. 1090-Z.). The applicant has submitted a survey dated March 2, 2005, revised 1-2-2007, by John C. Ehlers. BASIS OF APPLICATION: This appeal is based on the Building Inspector's December 18, 2006 Notice of Disapproval concerning an application for a building permit. The grounds cited in the Building Inspector's disapproval are: the proposed construction is not permitted under Section 280- 121. Except as provided hereinafter nonconforming use of buildings or open land existing on the effective date of this chapter or authorized by a building permit issued prior to, regardless of change of title, possession or occupancy or right thereof, may be continued indefinitely, except that such building or use: A) shall not be enlarged, altered, extended, reconstructed or restored or placed on a different portion of the lot or parcel of land occupied by such use on the effective date of this chapter, nor shall any external evidence of such use be increased by any means whatsoever. The structure was erected in 1960 under a permit, and under current zoning regulations, the structure is nonconforming. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred pursuant to Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated January 22, 2007 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: TOWN CODE CHAPTER 95 (268) LWRP DETERMINATION: The applicant wishes to make interior changes and structural upgrades to a nonconforming section of the existing two- section dwelling. While other structural components of the building are also in need of repair, none Pate 2—April 19,2007 • • ZB File No.6000—Vicki Haupt CTM No. 122-4-21 are shown on the architectural diagrams submitted with this appeal to include these areas under the building and safety codes. The application is exempt from the LWRP provisions only with regard to the current request for interior alterations shown on the architectural diagrams submitted with this application. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 22, 2007 and March 29, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: RELIEF REQUESTED: The applicant states that they wish to: (a) reduce the size of the existing bedroom, (b) enlarge the existing 21 sq. ft. bathroom, (c) enlarging the bathroom window, adding a new window on the southwest elevation, removing three windows and adding an awning and picture window, (d) removing and replacing three picture windows and one door, in kind, on the northeast elevation of this upper one-story section of the dwelling structure. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Town building permit records show that in 1966 the entire structure was built as a "one-family dwelling," built in two sections. A single-story portion of the seasonal dwelling contains nonconforming construction that has not been occupied for many years. The applicant states that the upper portion contains a bedroom and a bathroom used in conjunction with the lower two-story section, which is connected by a covered stairway. Testimony was received by Town Building Inspectors that the two-section building is not recognized as a single-family dwelling under the current code requirements and that the existing construction is nonconforming. Testimony also was received that other building areas will need to be addressed under the building codes for safety issues and conformity before occupancy. If the plan would address all unsafe areas on a plan, then there would be less risk of injury. 2. The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than the requested area variance. The alterations are proposed only to a nonconforming, deteriorated section of the building, without consideration of additional reconstruction to bring the building into conformity with the codes. 3. The relief requested is substantial. This section of the dwelling has not been occupied for many years. The lower two-story section with stairway connection to this nonconforming section should also be included in a building diagram with safety issues certified by a licensed architect or engineer for the occupancy of the entire structure as a conforming building with a single-family use, rather than continuing the nonconformity of the dwelling built in two nonconforming sections. 4. The difficulty has not been self-created and is related to the nonconformities on the premises. • Pale 3—April 19,2007 • • ZB File No.6000—Vicki Haupt CTM No. 122-4-21 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Weisman, and duly carried, to DENY the variance as applied for, without prejudice, and with recommendation that a complete building plan be offered to the Building Inspector that will bring the two-section building into conformity with the building codes, while meeting the zoning code requirement for occupancy on the premises for one single-family dwelling, rather than plans to repair and replace a section that does not meet building codes. The footprint of the house is composed of two separate buildings,which are connected together by a covered walkway. The two-story portion is sited towards the bluff aspect of the property,while the one story section is sited on the embankment behind the two-story structure. Little vegetation besides Japanese pachysandra occurs on this stony embankment on which the one story structure is constructed (Picture 1 &5). Both structures are fitted with gutters, down spouts and dry wells, with the exception of the north corner of the one story structure. At this location the downspout is discharging water directly onto a slope and active erosion is occurring (Picture 2 &3). A sprinkler system services this property for irrigation purposes(Picturel &4). Both structures in mention are located in dose proximity to a fully vegetated and stabile bluff. Bluff protection at this site is critical in order to protect the bluff itself and also the structural integrity of the structures mentioned above. Currently, the bluff is in good to excellent condition, which is difficult to achieve and maintain. Therefore, the following practices are recommended in order to ensure the bluff is protected from forces, which could threaten this stability(wind,water, &human activities). • • First, the downspout discharging water to the ground from the one story building, should be fitted with a dry well. This will prevent the erosion of the embankment and also prevent runoff from flowing over the top of the bluff(a catalyst for bluff erosion). Likewise, the use of sprinkler irrigation on this site should be used with caution due to erosion potential of the embankment and the close proximity to the bluff. It is recommended that this irrigation system only be used when absolutely necessary and monitored during operation, as water flowing down slopes and over the bluff face is the greatest threat to bluff stability. To reduce the dependence on irrigation and prevent erosion, it is recommended that shade and drought tolerant vegetation be used for erosion control and landscaping purposes around the structure especially in areas where ground disturbance (i.e. dry well installation and footer repair)or bare soil occurs. Lastly, in order to maintain bluff stability,the practice of disposing landscaping debris on the bluff face should cease. Such disposal methods smother the vegetation which is provides stability to the bluff face. Therefore, this debris should be composted or disposed of properly at the local sanitary facility.
